Legal Issues of Genetic Testing in Korean Bioethics and Safety Act

New genomic information and technologies are leading to the development and use of genetic tests to identify inherited variations in human genes tha affect an individual’s health and disease risks. Genetic tests are performed for different purposes and at different points in an individual’s lifetime. We can categorize genetic tests into several types based on the purpose of the tests. Recently, Article 50 (Restrictions, etc. on Genetic Tests) of Bioethics and Safety Act was revised to allow genetic testing institution, not a medical institution, shall conduct a genetic test in connection with the prevention of a disease when the Ministry of Health and Welfare admits need. It is so called as DTC(Direct To Clients). So there is some discuss about the range of DTC. Although genetic testings are very useful to enhance human health,there are some potential risks when we use genetic testings. Genetic test can makes some ethical, legal problems like harm to genetic privacy, problems of genetic discrimination, and abortion. Especially, genetic test for physical appearance or character, which has no reliable scientific proof and is likely to mislead the testee, and in DTC the risk of above will be more serious.
