Discussion of joint infringement of patent right had started from various type of sharing patent licences among multiple parties. To claim the patent infringement, one party who is willing to claim the infringement must meet all of the elements of patent licence but this couldn't effectively protect the patent right. To firmly protect the right of patentee, this kind of avoiding the responsibility of joint infringement of patent right by abusing the existing rule should be also regulated as new type of infringement. Traditionally, the study of joint infringement of patent right has been focused on requirement of patent eligibility and legal responsibility of infringement. In my previous research, I covered the type of joint infringement in patent law and method of regulation. This study is based on the necessity of more specific discussion of legal issues of joint infringement of patent right; Specific compensation measures of civil law and criminal law, measures for international joint infringement and issue of choice of governing law based on private international law. The research will develop the previous discussion of requirement of eligibility and responsibility of joint infringement of patent right and examine the recent issues that are listed above more throughly.

특허권 공동침해에 관한 논의는 특허발명의 다양화로 특허발명의 구성요소를 다수의 주체가 나누어 실행하는 일이 발생하면서 하나의 주체가 특허발명의 구성요소를 모두 실행하여야만 특허권 침해를 인정해 왔던 과거의 이론으로는 이에 대하여 효과적으로 대처할 수 없다는 우려에서 시작되었다. 특허권자의 권리를 효율적으로 보호하기 위하여는 기존의 특허권 침해이론을 이용하여 책임을 회피하는 특허권 공동침해에 대하여는 이를 침해로 규율할 필요가 있게 되었으므로, 그동안 특허권 공동침해에 관한 연구는 이러한 경우에 특허권 침해가 성립되는지 그리고 법적인 책임을 인정할 수 있다면 이를 위해 필요한 요건이 무엇인지에 대하여 집중되어 왔다고 할 수 있다. 필자 역시 기존의 연구에서는 특허권 공동침해의 유형과 그 규율방법을 다루고 있는데 그쳤으나, 특허권 공동침해에 대한 보다 구체적인 법적 쟁점 즉, 민, 형사상의 구체적인 구제방법이나 국제적 공동침해에 대한 대처방법과 준거법 결정에 관한 국제사법적 쟁점에 관한 보다 추가적인 논의가 필요하다고 생각된다. 따라서 본 연구에서는 특허권 공동침해의 특허권 침해 성립 여부나 그 책임의 인정 요건에 대한 논의에서 더 나아가, 특허권의 공동침해와 관련되어 대두된 위와 같은 최근의 법적 쟁점들을 해당 쟁점별로 보다 구체적으로 검토해 보고자 한다.
