Based on abovementioned theoretical background, contracting out for local government is defined as follows: local government entrusts or transfers its governmental services, not directly pertinent to the right and obligation of people, to a private corporation' organization, company or individual, and lets it implement the services under its name and responsibility. The purpose of this study is to suggest various plans for improvement of contracting out public services and transferring expenditure to public agencies in Jeju province. The paper reviews and compares an ordinance of contracting out public services of Jeju with that of Seoul. This study suggests alternatives to revise legislation for efficient contracting-out of public services of Jeju. The revision of ordinance of contracting out should includes consent of council, competition, supervision and performance evaluation and re-agreement for efficient contracting-out public services. Therefore, organizing the operational committee which monitors and supervises contracting-out facilities is needed.

본 연구의 목적은 민간위탁 및 공기관 대행사업 예산 증가율이 총예산 증가율에 비해 상대적으로 점점 높아지고 있으나 제도의 미비에 대한 문제가 제기되어 온 제주특별자치도의 민간위탁과 공기관 대행사업에 대한 운영현황을 파악하고 문제점을 진단하는 한편, 이러한 문제점을 극복할 수 있는 제도적개선방안을 모색하고자 한다.현재 제주특별자치도 사무의 민간위탁 조례가 있지만 좀 더 민간위탁에 대한 관리강화와 예산집행의투명성을 위해 좀 더 민간위탁에 대한 관리강화와 행정사무의 민간위탁에 관한 조례에 준한 개정이 필요하다. 의회동의 및 보고, 민간위탁 운영평가위원회 설치, 성과평가 시스템 도입, 수탁기관 선정 재계약에 대한 기준 등이 포함되어야 할 것이다. 또한 민간위탁의 타당성 검토를 강화하고, 민간위탁 사전․사후 관리역량 강화 등도 필요하다. 아직 마련되지 않은 관련조례에 대한 시행규칙 제정도 시급하다.장기적으로는 민간위탁사업인 경우, 경쟁력 있는 민간업체가 부족한 제주도의 현실을 고려할 때, 적극적으로 일부 사무시설관리를 위한 시설관리공단 설립․모색도 필요시점이라 할 수 있다.
