The bills sponsored by assembly members(BSA) have the merit: They bring out a question of a variety of social issues and collect extensive opinions of the nation. But there has also been criticism of excessive legislation from journalism, academia and the stakeholders. Accordingly, there is a debate that Regulatory Impact Assesment or Legislation Impact Assessment to BSA should be introduced for the reduction of social costs. But the studies how, who and when the Legislation Impact Assessment to BSA should be implemented have been rather restrictive. This paper analyzes the tendency and the present of the Legislation Impact Assessment of the key nations and contemplate the introduction of the Legislation Impact Assessment to the National Assembly of the Republic of Korea. This paper proposes the specific measures for the Legislation Impact Assessment to BSA: the subject or scope of the Legislation Impact Assessment, the forcibleness, the time of implement, the institution implements the procedure, the institution appraise the implement. and it will bring up the need of theorization and the establishment of methodology.

의원입법은 사회의 다양한 이슈에 대한 문제를 제기하여 현안 문제에 대한 국민의 의견을 수렴하는 역할을 한다는 장점이 있지만 최근 입법환경 변화에 따른 과잉입법에 대한 사회적 논란이 이해당사자는 물론 언론계, 학계를 중심으로 강하게 제기되고 있는 실정이다. 이에 의원입법과정에 규제심사 및 입법영향평가 등 사전적 심사제도를 도입하여 의원입법의 내실화를 기하여 정책수용성을 높이고 사회적 비용을 줄여나가자는 논의가 제기되고 있다. 하지만 의원입법 과정에 사전적 심사제도를 어떤 방식으로 입법과정의 어느 단계에서 또는 어느 기관이 담당해야 하는가에 대한 연구는 매우 제한적이었다. 본 논문은 입법영향분석을 강화하고 있는 주요 선진국들의 추세를 감안하여 이들 국가들의 입법영향분석제도를 분석하고 우리 실정에 맞는 제도 도입 방안에 대해 고찰하기 위한 목적을 지닌다. 이 논문에서는 의원입법에 대한 사전 영향평가제도 도입을 위한 구체적인 방안들에 대한 주요 내용을 제시한다. 즉 영향평가 대상 또는 범위를 어떻게 할 것인지, 영향평가에 강제성을 부여할 것인지, 영향평가의 작성시기, 영향평가서 작성기관, 영향평가 심사 기관 등에 관한 논의가 필요하고 이를 위한 이론화 작업과 방법론의 구축이 필요함을 제기한다.
