Study on the Social Responsibility of Multinational corporations in Islamic Law - Focusing on comparison with OECD guidelines for multinational enterprises - The OECD issued guidelines for multinational enterprises containing recommendations for responsible entrepreneurship in 1976, which were thoroughly revised in 2000. In the new guidelines, the chapters on employment, on environment and on transparency have been completely revised. In addition, new chapters on corruption and on consumer’s interests have been included. The chapter on employment fully covers freedom of association and recognition of the right to collective bargaining, freedom of all forms of forced labor, abolition of child labor and nondiscrimination in employment. Even though this code applies world-wide and is explicitly emphasized human rights, core labor standards and the protection of environment, it simply exerts moral pressure on multinational enterprises. That is, the binding legal force is missing in the OECD guidelines, even though their observance is encouraged by the OECD Member Countries. Islamic law has corporate social responsibility principles similar to the Western counterpart. Because commercial ethics are much more highly regarded in Islamic commerce than in the Western world of business. These underlying purposes include providing for the well-being of humans, diminishing hatred and disputes, and setting limits to human freedom. The purposes of Islamic law also include eliminating hardship and protecting the earth’s population as well as the purpose of promoting justice. In other words, Islamic nations have been seeking Islamic modes of CSR.

경제의 글로벌화가 가속화되고 다국적기업의 해외활동이 확대되면서 다국적기업은 글로벌 경제에 막대한 영향력이 미치고 있다. 이러한 추세에 따라 최근 세계적으로 기업의 사회적 책임에 대한 관심이 지속적으로 높아지고 있다. 그 결과 OECD는 다국적기업에 대한 가이드라인을 채택하기에 이른다. 그 내용들을 검토해보면, 서구사회에서 다국적기업의 사회적 책임은 직원, 소비자, 투자자, 공급자(이른바 “주요 이해관계자”) 그리고 환경(이른바 “2차 이해관계자”)과 같은 다른 모든 것들을 포함하는 다양한 이해관계자들에 대한 책임을 포함하는 것으로 이해할 수 있다.이러한 점에 비추어 볼 때, 서구적 관점에서의 다국적기업의 책임은 ‘본질적으로, 공공의 이익을 기업의 의사결정에 의도적으로 포함시키는 것이고, 트리플-버텀 라인(a triple bottom line: 기업 이익, 환경 지속성, 사회적 책임이라는 세 가지 기준으로 기업 실적을 측정하는 비즈니스 원칙)-사람(People), 지구(Planet), 이익(Profit)-을 존중하는 것이다.’ 그러나 이와 같은 다국적기업의 사회적 책임을 규정하고 있는 OECD 가이드라인은 스스로 ‘권고’적 성격에 그친다고 명시하고 있어, 그 실효성 확보에 있어서 많은 한계를 지니고 있다. 한편, 이슬람사회에서도 다국적기업의 사회적 책임에 관한 규정이 존재한다. 이슬람법은 다국적기업들로 하여금 사회의 전체적인 이익을 제공하고 해악을 방지하도록 한다. 주목할 만한 점은 이슬람법상 다국적기업의 사회적 책임은 그 범위가 현지국에의 활동에만 국한되는 것이 아니라 인류 전체에 대한 것을 아우른다는 점이다. 또한 강행규정적 성격을 지니고 있기 때문에 그 실효성의 담보가 훨씬 더 용이하다. 물론, 이슬람법의 이러한 성격은 종교적인 지도원리에 기초하고 있기 때문에 가능한 측면도 있다. 그러나 그 종교적 지도원리는 규제를 주 목적으로 하고 있지 않으며, 합법적인 범위 내에서 중용과 절제의 한계를 넘지 않도록 경고하고 있는 측면이 강하다. 따라서 전적으로 국가 또는 법률의 개입에 의존하지 않으면서도 기업이 스스로 자유로운 영리활동과 함께 사회 및 경제적 정의를 추구하게끔 하여 그 실효성을 확보하려고 하는 것이다. 이렇듯 이슬람법상의 다국적기업의 사회적 책임에 관한 개념은 현대의 서구식 관점에서의 그것이 갖는 한계나 문제점을 보완하고 해결해 나가는 데 중요한 시사점을 던져준다.
