상당수 노인범죄자들은 한 번의 범죄가 원인이 되어 범죄의 고리에서 벗어나지 못하고 있다. 이러한 악순환은 범죄인에 대한 시설 내 처우인 교정과 교화에서 효과를 거두지 못함은 물론 사회적으로 출소자 보호 관리체계의 미진함을 드러내고 있다. 따라서 노인범죄자의 재범방지를 실현하기 위해서는 기존의 시설 내 구금에서 사회 내 처우로 방향을 대전환하여 노인범죄자들에 대한 사회 내 처우로의 전환과 동시 기구조직과 인력, 재정적 지원이 따라야 되겠다. 예컨대 미국은 과거 30년간 수용자의 재사회화 및 출소자 사회복귀 프로그램에 정책적인 투자를 하지 않았고, 그 결과 재범을 비롯한 크나큰 사회적 병폐를 낳았다. 범죄, 수사, 재판, 교정, 갱생보호로 이어지는 일련의 범죄인의 처우과정에서 어느 한 단계마다 중요하지 않은 단계가 없지만은 재범방지를 위한 마지막 단계인 갱생보호단계 즉, 사회적 처우 단계가 실패하면 그 이전의 모든 단계가 성공적이었다 하더라도 결국 재범의 길로 접어 들 수밖에 없을 것이고 모든 단계의 노력은 수포로 돌아 갈 것이다. 하지만 이전의 전 과정에서 비록 재범예방을 위한 처우가 조금 부족했다 하더라도 최종단계인 갱생보호단계인 사회적 처우과정에서 실질적이고 체계적인 방향으로 나아간다면 재범방지의 효과는 나타날 것이다. 노인범죄자에 대한 효과적인 범죄예방과 실질적인 처우를 가능하게 하고 이들의 재범방지를 위한 사법 복지적 처우방안을 마련하는데 있다. 따라서 사법복지는 범죄문제에 대하여 형사사법기관과 사회복지기관 그리고 개인 상호협력‧공조체계를 유지해 가면서 범죄문제에 효과적으로 대처해 나아가야겠다.
