The improvement of law and ordinance about the military health-care accompanied by the development of the latest medical technology, conscription system, low birth rate problem is increasing the need for rational improvement with the expansion of the military welfare-area. In accordance with the political change in domestic and foreign affairs, the qualitative development of the military health-care policy will be greatly enhanced the morale of the military by formed the foundation of the qualitative development of the military health-care policy. 군 보건의료 관련법령은 군인 및 군무원 등 특정집단의 의료보장을 담당하는 법률에 해당한다. 군 보건의료시스템은 급속히 발전하는 민간 보건의료시스템을 제대로 수용하지 못하여 항상 낙후된 의료영역의 문제로 남아있다. 이러한 문제로 인하여 군인 및 군무원의 군 보건의료에 대한 만족도는 상당히 낮은 상태로 이들 조차도 민간의료의 영역에서 보건의료서비스를 주로 이용하고 있는 상태이다. 우리사회의 안보를 책임지고 국민의 안전한 경제활동과 생활을 보장하는 최전선에 있는 군인 및 군무원에 대한 최선의 보건의료혜택은 향후 모병제와 저출산 문제로 야기되는 국방력의 저하문제를 해소하기 위해서도 군 보건의료서비스의 개선은 긴급한 해결문제이다. 그동안 군 보건의료서비스의 개선을 위하여 군 보건의료 관련법령은 꾸준히 정비가 있어 왔지만 여전히 군 보건의료서비스는 민간에 비하여 상당한 격차를 보이고 있다. 현재 민간영역에 대한 보건의료서비스의 영역에 관한 법령은 약200여개에 이르며, 군 보건의료 관련 법령이 약33여건 정도로 상당히 다양한 영역에서 보건의료정책이 시행되어 왔다고 볼 수 있다. 그러나 군 보건의료서비스는 국방예산의 문제, 군 보건의료 인력의 확충과 전문성의 문제, 군병원의 효율적 운영 등에서 민간의료영역과 많은 차이를 보임으로서 군인 및 군무원의 군 보건의료에 대한 만족도는 그다지 높지 않아서 꾸준히 민간의 일반 보건의료서비스에 준하는 군 보건의료서비스를 제공하기 위하여 실효성 있는 법령의 개선이 필요하다. 군 보건의료 관련법령의 개선을 통하여 군 보건의료 혜택을 민간의료 혜택에 상응하는 수준으로 향상하여 군 보건의료 수혜자들을 위한 실효적인 헌법적 보건권과 의료영역의 평등권을 보장할 필요가 있다. 이를 위한 방법론으로 군 보건의료 관련 법령개선을 통하여 군 보건의료의 내실화, 군 보건의료 인력의 전문화, 군병원의 효율적 운영, 군 보건의료 정책의 지속적 발전을 도모할 필요가 있다.
