Hayek has become one of the most famous contemporary liberalist after the Eastern socialism collapsed. However, we must consider his ideas as a whole in order to appraise his liberalism because there are many variations in liberalism. we think that clarifying his theoretical inconsistency can be important in the indirect assessment of the inconsistency in Hayek's liberalism. Hayek's powerful defense of liberalism is based on a social theory which claims to explain the spontaneous co-ordination of a multiplicity of separatedly pursued individual actions. This study reviews the economic thought of Hayek in terms of economic order government. Primarily, Hayek regards economic order as spontaneous order based on cultural evolution. It is called "catallaxy". For him the most important thing is to protect the traditional morals and customs. Artificial order destructs catallxy and evolutionary tradition and it endangers our lives. Spontaneous social order which he spoke of is the result of human action, but not of human design. It emerges when the individuals observe rules of conduct, and the rules and spontaneous social order can be explained only in the evolutionary view. Liberalism, Hayek writes, 'derives from the discovery of a self-generating or spontaneous order in social affairs. He traces the intellectual roots of this theory of spontaneous order to the tradition of 'classical liberalism".

하이에크의 경제질서관을 형성하는 기본적인 태도는 각각 합리주의적 접근 방법과 진화론적 접근 방법이다. 이러한 지적 토대의 차이에 의해 경제질서를 바라보는 하이에크의 기본적 시각인 자생적 질서와 소망스런 경제질서의 구현 방식이 달라진다는 것이 주목할 만한 점이다. 질서관에 있어서 하이에크는 진화적 질서를 주장하며 진화론적 입장에서 입법부에 의해 규정되는 법이란 질서를 인정하고 있다. 하이에크를 일반적인 질서자유주의자들과 비교해보면 그는 질서자유주의자들과 마찬가지로 경쟁질서의 창출로 개인의 자유가 국가와 경제적 위력을 가진 타인으로부터 보호될 수 있다고 보았다. 하이에크의 자유방임은 진정한 사회정의를 위한 질서를 정립하고자한 적극적인 것이었다고 할 수 있다. 그가 생각하는 국가의 채무는 행위준칙을 ‘평등하게’ 적용하는데 있는 것이지 물질의 동등한 분배에 있는 것이 아니었다. 즉 탈법과 탈세, 특혜 등의 무법적 행위를 근절하고 공평한 법 앞에서의 평등을 실현시키는 것이 진정한 시장경제질서 원리의 정립인 동시에 사회정의 실현의 방법이다.
