Legislation and judiciary committee in Korean National Assembly is the exceptional case in the cross-national perspectives and the inner status of Korean National Assembly. Because Korean Assembly has the sequential referrals and compulsory second review process-the second review of legislation and judiciary committee after the other committees’ first review. The function of the second compulsory review is the examination of legality and wording. By this time, the function of the second review has been criticized by the inefficiency of legislative process, the politicization of policy consideration and the unconstitutionality of the judicial review. This study shows the embedded unique principles of this function by analysing the history of Korean National Assembly Laws and theirs behind stories, and proposes that the essential problem of the second compulsory function is the lack of the parliamentary rules’ endogenous device controlling the abuses of the committee’s second compulsory power.

한국의 법제사법위원회는 국가 간 비교의 관점에서, 또 국회 내 그 지위에서 예외적인 존재다. 법사위 체계·자구심사의 순차심사, 강제심사의 성격은 법사위를 단원제 의회 내 ‘제2원’의 성격을 갖도록 만든다. 지금까지 법사위의 이 기능은 입법절차의 비효율성, 정책심의의 정치화, 위헌법률심사권의 위헌성 등을 이유로 비판을 받아왔다. 본 논문은 이 기능의 생성과 발전과정을 역사적으로 추적함으로써, 법사위 순차, 강제심사제도에 내재한 입법과정에 대한 독특한 원리를 밝히고자 한다. 이를 위해 1919년 대한민국 임시정부 임시의정원에서부터 제4공화국에 이르기까지 국회법 제도의 변천사를 분석하였다. 그리고 현행 국회법 체제에서는 법사위의 강제심사가 제한심사를 넘어선 월권을 행했을 때 이를 제한할 수 없는 내재적 장치의 결여되어 있는 것이 본질적 문제임을 주장한다.
