According to the Korean Criminal Procedure Law §§ 216 ① ii and ③, 217, police officers can search and seizure the item related to suspected crime without prior warrant. This article focused on the important question about these rule based on exigent circumstances exception can be applied to the cell phones without any additional restriction. The modern cell phones stores immense quantity of data and the stored record and information are also qualitatively sensitive. If police officers can search and seizure the data of cell phones with no restriction, it cause a broad and severe intrusion on citizen's privacy. Under such a judgement, this article insists that a warrant is generally required before a search of cell phones, even when a cell phone is seized according to the exception provision of prior warrant requirement. That is because digital data stored on a cell phone cannot used as a weapon to harm an arresting officer and privacy associated with cell phones differ in both quantitative and a qualitative sense from other searchable objects.

현대인의 일상생활의 불가결한 부분이며 인간의 자율성의 중요 부분이기도 한 휴대전화는 19세기 근대 형사소송법이 성립될 당시에는 상상할 수 없었던 기술에 기반하고 있다. 형사소송법 제216조 제1항 제2호 및 제3항 그리고 제217조 제1항을 기계적으로 적용한다면, 경찰관은 사전영장 없이 피의자의 휴대전화를 압수수색할 수 있다는 결론을 가져올 것이다. 긴급압수수색 규정은 피의자를 체포하는 경찰관이나 제3자의 생명·신체의 보호, 증거인멸 또는 은닉을 방지하기 위한 긴급 상황에서 사전영장주의의 예외를 인정하는 조문들이다. 그러나 물리적·유체적 증거에 대한 긴급압수수색의 경우에는 경찰관에 대한 위해와 증거인멸의 위험을 이유로 사전영장주의의 제약 없이 피의자의 사생활의 비밀과 자유 및 정보자기결정권의 제한하는 것이 적절한 균형을 유지할 수 있지만, 휴대전화에 저장된 전자정보에는 이러한 논리가 적용되기 어렵다. 휴대전화에 저장된 전자정보는 무기나 흉기가 아니며 일단 압수되면 증거인멸의 우려는 현저히 감소되고(긴급성의 결여), 휴대전화에는 방대한 양의 민감한 개인 정보가 담겨져 있어 휴대전화에 저장된 전자정보에 대한 제약 없는 압수수색은 개인의 사생활과 비밀의 자유를 침해하게 되기 때문이다(비례성의 결여). 따라서 현행법상 긴급압수수색 규정에 따라 사전영장 없이 피의자의 휴대전화를 수색하는 것은 허용되지 않는다고 보아야 한다.
