The purpose of this study is to analyze the work process and workload of insurance fraud investigation team in the police nationwide, which is expected to make a fundamental contribution toward building up some standard job and manpower model for investigation capacity strengthening against intelligence crime. According to the results of estimation based on the survey to the team, the average time to require in the preliminary investigation stage by a case is turned out to be 25.96 hours especially in the criminal intelligence collection to begin with, and 32.83 hours in the intelligence analysis, and 75.49 hours in the initial investigation. In the next, the time to require in the principal investigation stage is estimated to be 54.83 hours in the investigation to criminal suspects, 16.99 hours to testifiers, 12.51 to victims, 110.86 hours in evidence analysis, 60.97 hours in the tracking investigation, and 10.16 hours in the investigation direction respectively. Finally, the time to require in the finishing stage is 64.12 hours in document filing, and in summing up, the total time to the insurance fraud investigation is estimated to be 454.1 hours by a case. On the other hand, this study demonstrates that the investigation capacities of the police are now so limited in contrast to criminal investigation activities expected from insurance business circle and supervisory authorities. That is, as insurance fraud is a very difficult case to need longer time than other economic crimes, there is a limitation to the investigation team responsible for the fraud crime, especially short of manpower.

본 연구는 지능범죄 수사기능의 수사역량 강화를 위한 직무․인력 표준안 마련에 앞서 전국 경찰관서 보험사기 전담수사팀의 수사 프로세스 및 그 업무량을 분석하고자 하였다. 분석 결과, 첩보수집 25.96시간, 첩보분석 32.83시간, 초동수사 75.49시간, 피의자조사 54.83시간, 참고인조사 16.99시간, 피해자조사 12.51시간, 증거분석 110.86시간, 추적수사 60.97시간, 수사지휘 10.16시간 서류정리 64.12시간 등 1건당 평균 454.1시간이 소요된 것으로 추정되었다. 세부업무별로 보았을 때 가장 많은 시간이 걸린 것은 증거분석으로 약 111시간이 소요되었으며, 다음으로 초동수사가 약 76시간이었다. 이는 보험사기가 전형적인 지능범죄로서 초동수사에서 범죄사실과 유죄증거의 확보, 아울러 본 수사 단계에서 증거의 분석이 매우 핵심적이라는 것을 보여준다. 보험종류별 사건처리 시간을 보면 생명보험이 약 527.7시간, 손해보험이 약 313.5시간, 사회보험이 390.9시간, 다중보험사건이 743.5시간으로서, 2개 이상 다수 보험종목에 가입하여 보험금을 편취한 다중보험사건이 가장 많은 시간이 소요된 것으로 추정되었다. 세부 보험종목별 처리 시간에서는 생명보험 중에서도 상해보험 종목의 경우, 평균 약 515.5시간으로 가장 많은 시간이 소요되는 것으로 나타났고, 손해보험에서 대표적 종목인 자동차보험의 경우는 가장 사건 수가 많은 종목인 반면, 그 처리시간은 295.4시간으로 가장 적은 시간이 소요되었다. 한편 본 연구는 보험업 유관 기관 등으로부터의 보험사기 수사 기대에 비해, 사실상 그 업무수행이 매우 제한될 수밖에 없다는 것을 실증적으로 보여주었다. 즉 보험사기는 다른 경제범죄에 비해서도 그 수사가 매우 장기간에 걸친 높은 난이도의 사건으로서, 지능범죄 수사기능 내의 보험사기 전담수사팀이 현재의 제한된 인력을 가지고 보험사기 범죄만을 지속적으로 대응하기에는 한계가 있다는 것이다.
