In the history of the mankind, religious leaders were leaders of the society. However, as the realms of politics and religions were separated with modernization, religious leaders were no longer able to lead the state. But religion still has influence on the modern society. Korea has a great diversity of religions - all the world's major religions coexist. Half of the population whose number is constantly increasing believe in religion, and engage in religious activities. More than 100,000 religious organizations are currently active. Religion has a close relationship with the lives of Korean people. Half of the population are religiously active, and the other half who does not have a religion uses social service of hospital, schools, social welfare, and cultural institutions operated by religious organizations. Nevertheless, the number of religious organizations which are registered as non-profit corporate under the civil law are no more than 750. This is a very small number compared to Japan's case where 182,121 out of 222,280 religious organizations are registered as corporates. Korea's constitution and law have clauses on religion and religious organizations. These laws regulate each of these organizations, but they are not addressing the various problems raised, because there is no law which directly regulates religious organizations. However, we have witnessed that religious organizations have caused big social problems. Especially when a religious organization is run by a religious leader, the issue of privatization and inheritance of the organization, and property disputes were raised. According to the current law, religious organizations can be classified to a non-profit corporate and a foundation without a legal personality. Legal status of religious organizations is about the reasonable balance between the various legal interests of these organizations and the freedom of religion. It is also about regulating organizations which is having negative effects on the society. The current legal system does not reflect the unique characteristics of each religious entities. A law that directly regulates religious organizations is needed, and these organizations should be corporatized for their establishment and activities to be under the auspices of state.

인류의 역사에서 종교단체의 수장은 사회의 지도자였다. 사회가 발전하면서 정치와 종교는 분리되었고, 종교의 지도자는 더 이상 국가의 지도자가 될 수 없었다. 그렇지만 현대사회에서도 종교는 여전히 사회에 영향력을 가지고 있다. 우리나라는 수많은 종교가 공존하는 종교백화점국가이며, 국민의 절반 이상이 종교를 믿고 활동하고 있으며, 종교인구도 지속적으로 증가하고 있다. 그러다보니 우리나라에는 십만 개가 넘는 종교단체가 활동하고 있다. 우리나라 국민은 절반 이상이 종교생활을 하고 있으며, 종교가 없는 경우에도 각 종교단체에서 운영하고 관리하는 각종 문화재관람, 병원, 학교, 복지시설, 문화시설 등을 이용하는 등 국민의 실생활과 종교는 밀접한 연관을 가지고 있다. 이러한 상황에도 불구하고 민법이 규정한 바에 따라 비영리법인으로 등록된 종교단체는 705개에 불과하다. 이 숫자는 대략 20만개 이상에 달하는 일본의 사례와 비교하면 극히 적은 숫자이다. 실제 일본의 종교 현황을 조사한 것을 보면 종교단체 수는 222,280여개이며, 이중 종교법인은 182,121개이다. 현재 우리나라에는 종교와 종교단체에 관하여 헌법과 법률에 관련 규정이 있다. 이러한 법들이 각 종교단체들을 규율하고 있으나, 종교단체에서 발생하는 여러 문제를 해결하지는 못하고 있다. 왜냐하면 종교단체를 직접 규율하는 법이 없기 때문이다. 그런데 우리 사회에는 종교단체들이 간혹 큰 사회문제를 야기하곤 한다. 특히 종교단체가 특정 종교지도자에 의하여 운영되는 경우 사유화, 세습화의 문제가 발생하고, 이익단체나 영리단체처럼 재산분쟁사건이 발생하기도 한다. 종교단체는 현행법상 비영리 법인의 형태와 법인격 없는 재단 내지 사단의 형태로 나눈다. 종교단체의 법적 지위에 관한 문제는 각 종교단체의 다양한 법률관계를 종교의 자유 하에서 합리적으로 어떻게 조화시킬지 여부와 역기능을 하는 단체에 대한 규제문제이다. 종교단체의 분쟁이 벌어지면 각 종교단체의 특성이 반영되지 않는 경우가 대부분이다. 이런 문제를 해결하기 위해서는 종교단체를 규율하는 법규가 필요하며, 종교단체의 설립과 활동에 대하여 국가의 감독과 관리를 받는 법인화가 필요하다.
