Where can be found constitutional soild ground to strengthen solidarity of social disadvantaged people in social state, which exists for their living and is being mantained through their solidarity? With regard to it a good example for comparative constitutional law study is discovered in Articel 34 in the Charter of Fundamenta Rights of the European Union and the ruling of the German Consitutional Court in Hartz Ⅳ case coferring right to ensure subsistence minimum corresponding to human dignity as constitutional rights. In the Hartz Ⅳ decision the German Constitutional Court create right to guarantee subsistence minimun corresponding to human dignity as an individual’s enforceable constitutional rights carefully. This right can be inferred from human dignity in Article 1 of the German Basic Law in combination with the social state principle in Aricle 20 of the German Basic Law. It is very useful for us to search for comparative constitutional interpreatation for social rights to make normative force of right to live in existence fit for human being in artice 34 in the Korean Constitution more stronger. I think it will be interesting and promising work.

사회적 약자들의 인간다운 최소한의 생존을 보장하기 위한 사회국가(Sozialstaat)는 이들의 연대성(Solidarität) 보장을 통해서 실현된다. 그렇다면 이들의 연대성의 기반이 되는 최소한의 생존보장을 실현하기 위한 헌법적 근거를 어디에서 찾아야만 하는가? 독일연방헌법재판소(Bundesverfassungsgericht)는 2010년 2월 9일의 사회법률의 제2편(Zweites Buch Sozialgesetzesbuch(SGB)), Hartz Ⅳ-법률(Gesetz)에 의한 정기적 급여(Regelleistung)에 대한 자신의 결정 속에서 이전의 판례들과 연계해서 기본법 제20조 제1항과 결부된 기본법 제1조 제1항에 근거한 인간다운 최소한의 생존을 위한 기본권(Grundrecht auf Gewährleistung eines menschenwürdigen Existenzminimum)을 도출해 내었다. 우리 헌법 제34조의 인간다운 생활의 보장은 단지 인간다운 생활을 영위하기 위한 최소한의 생존보장만을 포함하고 있다고 해석하고 있다. 그럼에도 불구하고 우리 헌법 제34조의 인간다운 생활을 할 권리가 어느 정도까지의 최소한의 생존보장을 규정하고 있는지 여부에 대한 구체적인 헌법이론적인 해석기준 뿐만 아니라 헌법재판소나 법원의 판례를 통한 실무적인 헌법해석기준 역시 우리나라에서는 명확하게 제시되지 않고 있다. 이와 관련하여 유럽연합의 기본권 헌장(Charta der Grundrechte der Europäischen Union) 제34조의 사회적 안전(soziale Sicherheit)과 사회적 지원(soziale Unterstützung)의 보장 그리고 독일에서의 기본권으로서 인간다운 최소한의 생존보장을 위한 기본권의 보장과정에 대하여 살펴보는 것은 우리 헌법 제34조 인간다운 생활을 권리의 구체적 권리로서의 보장실현에 기여하는 매우 중요한 비교헌법적 연구가 된다.
