In Japan, It is superior status that freedom of expression than other freedom in constitutional provisions established in the dominant position. Also constitutionally review the content and the limitations of freedom of expression in Japan. Based on the review at the potential of racism and discriminatory restrictions on expression. 일본에서는 표현의 자유가 다른 자유보다도 우월적 위치에 있다는 내용이 헌법상 확립되어 왔다. 그러나, 재일코리안에 대한 인종차별과 함께 차별적 표현의 문제가 심각한 사회 문제가 되고 있다. 특히 최근에 조총련계 초등학교에서 발생한 인종차별의 문제로 인하여 더욱 심각한 차별문제가 발생하였다. 이에 인권옹호법안의 제정과 표현의 자유와의 규제와의 헌법적 논의가 전개되고 있다. 따라서, 본 논문에서는 인종차별철폐조약에 따라 일본에서 이루어지고 있는 차별적 표현에 대한 헌법적 논의와 함께 인종차별금지법안에 대해서도 검토하고자 한다. 차별적 표현에 대한 규제에 대해서 표현의 자유의 우월성으로 인하여 사전억제와 표현의 자유의 위축효과라는 비판으로 인하여 법제정은 어려운 실정이다. 그러나 일본의 현재 상황은 심각한 인종차별의 형태가 이루어지고 있는 상황에서 표현의 자유에 대한 제한이 필요한 실정이다. 따라서 일본 내에서 헌법적으로 표현의 자유의 내용과 그 한계를 검토하여, 이를 바탕으로 인종차별과 차별적 표현에 대한 규제의 가능성을 살펴본다. 마지막으로 일본과 한국의 공통의 연구를 통해서 인종차별철폐와 차별적 표현에 대한 금지를 위해서 우리도 조속히 관련 법률에 대한 논의가 진행되기를 기대하는 바이다.
