This paper aims to explore the debate over speech codes in American universities which are not just measures for speech purification but ways of realizing social justice providing equal treat for the minorities, and to call attention to their importance in multicultural studies in Korea. In 1960s multicultural movement in America became active protesting racial, sexual and cultural prejudices, but did not reach to the regulation of hate speech. In the late 1980s political correctness supporters argued for the regulation of hate speeches, which brought about enactment of speech codes. However, those who opposed to political correctness demanded the right of free speech on the basis of Amendment Ⅰ. In 1987 both groups had heated debate over speech codes and today most universities have their own speech codes of which scopes are different. Nowadays speech codes are criticized in 2 ways. One is that they are unconstitutional because they violate the right of freedom of expression. The other is that their scope is overwide and their expression is vague. Therefore mutual consent of both sides on the optinum of scope and clarity of expression are required to enact speech codes, and they are also needed in multicultural studies in Korea.

본 논문의 목적은 혐오스피치의 규제에 관한 스피치코드가 단순히 언어문제가 아니라 소수자집단의 평등 차원에서 제기된 사회적 정의 문제임을 밝힘으로써 한국에서도 스피치코드의 논의가 필요함을 제안하는데 있다. 1960년대 미국의 다문화운동은 인종·계급·젠더 등에 대해 편견 문제를 제기하면서 활발하게 전개되었지만, 혐오스피치에 대해 이의를 제기하는 것으로 나아가지 못하였다. 1980년대 후반에 이르면 정치적 올바름(PC)지지자들은 혐오스피치에 대한 규제의 필요성을 제기하였고, 이는 대학에서 스피치코드 제정으로 나타났다. 이에 anti-PC지지자들은 수정헌법 1조를 근거로 하여 프리스피치를 주장하였다. 1987년 이후 두 진영은 스피치코드의 범위를 두고 치열한 논쟁을 하였다. 스피치코드의 범위는 대학에 따라 다르다. 오늘날 스피치코드는 두 방향에서 비판받고 있다. 하나는 스피치코드가 수정헌법 1조의 표현의 자유를 제한하기 때문에 인권을 침해한다는 비판이다. 다른 하나는 스피치코드의 필요성은 인정하지만, 그 범위가 광범위하며 표현이 모호하다는 비판이다. 따라서 스피치코드 제정에는 그 범위의 적정성과 표현의 명료함에 대한 합의가 필요하며, 다문화교육 연구에서도 이에 대한 논의가 필요하다고 본다.
