The reemployment of public officers after retirement have caused serious problems in these days. Especially, the problem of corrupted officials are come up in the corruption scandal of the Korea Hydro & Nuclear Power Co. and the disaster of Sewolho. By being reemployed in the related organization, the public officers tries to get the favor or reregulation from the government which they worked. These behaviors cause interest conflict between public interest and private interest. Therefore, this study research about the phenomenon of reemployment of public officers, the reason of that corruptions and rent seeking activity in the two case. In the conclusion, this study suggest that the way to rationalize the role of lobby to avoid the illegal behaviors which the retired officers do.

최근 사회적 물의를 일으킨 한수원 원전비리사건 및 세월호 참사 등에서 공직자들이 퇴직 후에 유관기관에 재취업함으로써 발생되는 ‘관피아’의 문제점이 제기되었다. 이들 사건들에서 퇴직공직자들이 자신의 공직업무와 관련된 기관에 재취업함으로써 실질적으로 특정한 기관 및 기업에 특혜 및 규제완화를 가져오고자 하는 역할을 비합법적인 방법으로 행하였던 것이 드러난 것이다. 이러한 퇴직공직자의 재취업으로 문제를 일으킨 두 가지 사례를 대상으로 지대배분자, 지대추구자, 로비스트라는 행위자들의 사적이익을 추구함으로써 발생하는 현상을 지대추구이론적 시각으로 고찰해보고자 하였다. 지대추구이론을 통해 이들의 문제를 살펴볼 때 퇴직공무원들의 로비스트로서의 활동은 막기 어려우며, 퇴직공직자의 재취업으로 인한 문제를 막기 위해 제정된 관피아 방지법, 김영란법 등의 실효성에 대해서는 확언하기는 어렵다. 실질적으로 오히려 퇴직관료를 적극적으로 활용하고자 하는 방안이 필요할 것이다.
