This paper mainly focused on analyzing the “Environment and Trade” chapter under Korea-China FTA, which became effective in 2015. This chapter has nine Articles including a duty to increase the level of environmental protection, bilateral cooperation to enhance the environmental protection, establishing the environmental committee and etc. It is a very significant chapter for both parties since China had never had a separate environmental chapter having the substantive rights and obligations of the parties before. However, this chapter lacks the procedural provisions which may ensure fairness and transparency. In order to have an institutional framework to ensure both parties are in following this chapter, the roles of the Committee on Environment and Trade should have been clearly defined. Adoption of effective dispute settlement system will be needed in order to settle the disputes arising from rights and obligations under environment chapter. In addition, even though this chapter has an environmental impact assessment, but it is not clear when it has to be done. Since an ex-ante environmental impact assessment does help to draw an effective trade and environmental polices, this ex-ante assessment should be considered.

한·중 FTA의 환경과 무역챕터는 총 9개의 항으로 구성되어 환경보호 수준의 지속적 제고 노력 의무, 무역과 투자 증진을 위한 환경보호 수준의 저하 금지, 양자 협력 및 환경위원회 설치 등을 다루고 있다. 동 챕터가 가지는 가장 큰 의의는 중국이 기체결한 FTA와 비교하여 보건대, 환경관련 분야의 구체적인 규정 및 내용이 포함되어 있고, 환경위원회 설치 등의 꽤 수준 높은 환경챕터를 구성하고 있다는 점이다. 이에 본고에서는 한·중 FTA 협정문 제16장의 ‘환경과 무역’챕터를 분석하고 평가하여 추후 성공적인 환경관련 통상 양자협상을 위한 정책적 시사점을 도출하였다. 첫째, 한·중 FTA는 환경보호와 관련하여 실체적인 의무사항을 규정해 놓은 것은 높이 평가할 만하나, 절차의 공정성 및 투명성 확보를 위한 절차적 제도의 도입이 이루어지지 않은 점은 다소 아쉽다. 이에 절차적 제도 도입을 장치를 사전에 준비해 두어야 할 것이다. 둘째, 환경챕터와 관련된 환경과무역에관한위원회의 역할을 구체적으로 규정해둘 필요가 있다. 셋째, 환경챕터 상 발생하는 분쟁을 효과적으로 해결할 수 있는 적절한 분쟁해결 절차 및 방법을 제시하는 것이 필요하다. 넷째, 환경챕터에서 사용되어지는 용어의 정의(definitions)를 포함해두어 분쟁 시 발생할 수 있는 해석상의 다툼을 사전에 예방해두는 것도 필요하다. 마지막으로, 통상정책과 환경정책이 상호 보완적이고 통합적으로 고려되어지기 위해서는 경제적 효과 분석뿐만 아니라 사전적(ex-ante) 환경영향 평가를 함께 실시하는 제도를 도입하는 것도 필요하다.
