Professor Han, Sang-Bum served as a professor and honorary professor of the College of Law and Political Science in Dongguk University, director of the Center for Historical Truth and Justice, and Chair of Presidential Truth Commissions of Suspicious Deaths. He was also the president of The Korea Law Professors Association Inc., and audit of People's Solidarity for Participatory Democracy. Professor Han is a lifelong scholar and rare intellectual whose academic perspective has been consistent with his path of life and he is evaluated as a representative “unyielding sprit” in the legal academia. He signed his name as a member of professor group opposing the Korean-Japan Agreement in 1964 and joined the objection protest. He opposed the 3rdconstitutional reform of Park Chung-hee’s regime in 1969. He reported “A Study of Vestige of Japanese Law Science that Had Dominated Korean Legal Academia” in History Critics in 1991 and raised a formal issue about the obliteration of the Japanese vestige. Professor Han has participated in many campaigns to obliterate the Japanese vestige, its practice and education, and civil movements. Also, he criticized maladies of authoritarianism, bureaucracy, militarism, and fascism that the Japanese law system left and analyzed consciousness structure of Korean and Japanese law scholars. He also disclosed illegally amassed wealth of pro-Japanese Koreans and their properties obtained in the colonial period and contributed greatly to obliterating the Japanese vestige. Professor Han raised issues about socially-alienated class and introduced “methodologies in terms of sociology of law’ to Korean constitutional studies for the first time in Korea. Also, his writing, “Constitutional Studies of Professor Han, Sang-Bum” contributed to developing Korean constitutional studies based on Korean contemporary history while maintaining universal theories and general characteristics of world history, at the time when Korean academia of constitutional studies were just contented with European theories and there fore, the imported western constitutional studies dominated legal academia of Korea as a cultural power. The academic achievements of Professor Han comprise diverse areas including constitutional studies, human rights, sociology of law, women’s studies, and Buddhism. This study is an introductory study of Professor Han, Sang-Bum who has developed constitutional studies and Dongguk law studies as a 2nd–generation constitutional law scholar of Korea. We hope this study becomes a momentum for the evaluation and review on his academic achievements. As a first step for this, this study introduces the professor Han and summarizes his profiles.

한상범 교수는 동국대학교 법과대학 교수와 명예교수, 민족문제연구소 소장과 대통령 소속 의문사진상규명위원회 위원장을 역임했다. 또한 한국 법학교수회 회장, 참여연대 고문 등으로 활동했다. 한상범 교수는 평생 학자로서 학문적 입장과 삶의 궤적이 일치하는 보기 드문 지식인이며, 법학계의 대표적인 ‘반골’이라 평가받고 있다. 1964년 한일협정반대교수단으로 서명했고, 반대시위에 동참했으며, 1969년 박정 희의 3선개헌에 반대했다. 1991년《역사비평》에 “한국 법학계를 지배한 일본 법학의 유산”을 발표해 일제 잔재 청산을 공개적으로 문제화했다. 한상범 교수는 많은 법학자들의 압력에도 일제 잔재 청산 작업과 실천 및 계몽운동과 시민운동을 해 왔다. 또한 일제 법제가 남긴 권위주의․관 료주의․군국주의․파시즘의 병폐와 한국 법학자와 법조인의 의식구조를 분석하고, 친일파의 부정 축재와 재산 문제 등을 폭로해 일제 잔재 청산 에 큰 업적을 남겼다. 한상범 교수는 사회문제와 사회소외계층에 대한 문제제기와 한국 헌법 학에서 ‘법사회학적 방법론’을 최초로 도입하여 연구한 학자이다. 또한 ‘한 상범 교수의 헌법학’은 우리 헌법과 헌법학계가 구미 제국의 학설과 이론 수입에 자족하고, 수입 헌법학이 문화권력으로서 우리 학계를 지배하고 있을 때, 보편적 논리와 세계사적 일반성을 유지하면서 한국 근현대사에 뿌리를 두면서 한국헌법학을 발전시켰다. 한상범 교수의 학문적 업적은 헌법학, 인권론, 법사회학, 여성론, 불교론 등 다방면에 걸쳐 있다. 본고는 대한민국 2세대 헌법학자로서 헌법학을 일구고, 동국법학(東國 法學)을 가꾸신 한상범 교수의 학문적 업적에 대한 평가와 재조명의 계기 가 되기를 기원하는 시론(試論)적 연구이다. 우선 교수님을 소개하고 정 리하는 데 그 의의를 두고자 한다.
