cause of the lack of public financial situation, many Countries have difficulty in increasing infrastructure facilities. One of the plans to solve these problems is using private investment. Many infrastructure facilities, including road, port, are constructed on Public-Private Partnership. However, in this process, many PPP, Seoul-Gwangmyeong PPP highway, Guri-Pocheon PPP highway, Seoul-Munsan PPP highway, confronted the conflict to the local residents. Lately PPP system improvement focused on rapid succession of procedure. But if public conflict is not solved, PPP system improvement is meaningless. It’s difficult to understand the opinions of the local residents to NIMBY. It is a just symbolic significance to conflict resolution provisions in Private Investment Project Basic Plan, so virtually ineffective. More information on PPP project should be provided to the local resident. It’s raised regulation to a wider variety of ways to gather the opinions of the local resident. Through increase number of committee members in dispute mediation committee in act on Public-Private Partnerships in infrastructure, the opinion of disputing party should be objectively reflected. It’s considered to utilize for resolving disputes to competitive dialogue that amended Private Investment Project Basic Plan in 2015. Relationship between private enterprise and local resident must be based on mutual trust. Even if infrastructure facilities, PPP is required for understanding and relationship of local resident. The public conflict to the local residents should not disparaged to NIMBY. Rather the public conflict to the local residents must be reflected to PPP project. In the process, We try to find ways to achieve harmony between public purpose to arrange infrastructure facilities and purpose of the business to creating profit.

많은 국가들이 국가의 재정부족으로 인해 사회기반시설을 확충하는 데 한계에 직면하고 있다. 이러한 문제점을 해결하기 위한 방안 중 하나로 등장한 것이 민 간투자를 통한 사회기반시설의 확충이었다. 도로, 항만 등 많은 사회기반시설이 민간투자를 통해 마련되고 있다. 그러나 이 과정에서 광명～서울 민자 고속도로, 구리~포천 민자 고속도로, 서울～문산 민자 고속도로 등이 경우에는 지역주민과의 심각한 갈등이 발생하면서 사업이 지연되기에 이르렀다. 최근 민간투자 관련제도의 개선은 절차의 신속을 중시하고 있지만 갈등해결이 되지 않는다면 이러한 절차개선은 그 의미를 찾기 힘들다 고 할 것이다. 지역주민의 의견을 과거와 같이 지역이기주의로 치부하 기에도 한계가 있다. 갈등해결을 위한 협의회는 민간투자사업기본계획 에서의 갈등해결을 위한 규정은 선언적인 의미에 불과하여 그 실효성 이 낮다고 할 것이다. 이를 해결하기 위해서는 지역주민에게 관련 정보가 충분히 제공되고 보다 다양한 방식으로 주민의견을 수렴할 수 있는 제도가 마련되어야 한다. 민간투자법상의 분쟁조정위원회의 위원회 구성을 변경하여 분쟁 당사자들의 의견을 보다 객관적으로 반영할 수 있도록 하여야 한다. 또한 민간투자사업의 절차의 신속을 위해 도입된 경쟁적 협의절차과정 에서 갈등요인을 사전에 제거할 수 있도록 하는 방안이 고려될 수 있 다. 무엇보다 민간투자사업에서는 무엇보다 국가, 민간사업자와 지역주민간의 상 호신뢰를 구축하여야 한다. 사회기반시설이라 할지라도 지역주민의 이해가 전제되지 않는 상황에서는 과거와 같이 국가의 일방적인 사업 추진을 할 수 없으며 사회기반시설 확충이 라는 목표달성도 실패하게 된다. 지역주민과의 갈등을 지역이기주의로 폄하할 것이 아니 라 이를 반영하면서 사회기반시설의 확충이라는 공공의 목적과 일정 수익 창출이라는 민 간의 목적을 조화할 수 있는 방안을 모색하여야 할 것이다.
