We analyze the China-specific trade remedies rules, the outcome of China's WTO accession negotiations. First, we discuss the non- market economy treatment issue. After reviewing the provisions in GATT 1994, the WTO Anti-dumping Agreement and the China's WTO Accession Protocol, we examined how the rules are implemented at the national level. Next, we analyze the transitional product-specific safeguard mechanism (TPSSM). We compare the WTO Agreement on Safeguards and the TPSSM provisions of the Accession Protocol. Then, we examine TPSSM rules in national legislations. We conclude with future issues such as the determination of appropriate benchmarks for the allegedly illegally subsidized Chinese products.

본 논문은 중국이 WTO에 가입한 이후 중국에만 적용되는 무역구제관련 규정들을 분석하였다. 반덤핑조사대상 중국 제품의 정상가격산정시 적용되는 비시장경제대우와 관련된 WTO협정 등을 살펴본 뒤에 주요국의 대중국 비시장경제대우규정을 분석하였다. 그리고 중국산 수입의 급증을 규제하기 위한 대중국 세이프가드제도의 법적 근거를 검토한 뒤 일부 국가의 동제도 운용현황을 분석하였다. 끝으로 규제대상 보조금을 받은 중국제품에 대한 상계관세조사시 제기될 수 있는 적정기준점의 산정문제를 향후 과제로 제시하였다.
