Responsible lending is an important safeguard for the borrowers to get credit benefits, while irresponsible lending may bring excessive debt for consumers and even leads to financial crisis. In order to solve the problem of over-indebtedness, prevent the economic crisis and protect the interests of financial consumer some countries have taken the responsible lending systems as an efficient tool. The responsible lending requires the lender hold the lending “principle of suitability” and carry out the statutory duty and agreement duty. The lender not only should assess the borrower’s loan repayment capacity、loan requirement and level of risk, but also shouldn't provide the unfit loan services for the borrower. In order to establish a fair, efficient, responsible loan system in China, this article analyses the foreign countries’ responsible lending regulations carefully, and gives effective suggestions in building our responsible lending systems.

대출행위에 대해 책임을 지는 것은 대출자의 신용복리 향유의 중요한 보장이다. 반대로 책임을 지지 않는 대출은 소비자에게 과도한 부담을 야기할 수 있다. 심지어는 금융위기의 도화선이 될 수도 있다. 많은 국가들은 각국의 상황에 따라 과도한 부채문제의 관리(통제), 경제위기 예방, 금융소비자 이익의 보호를 위해 책임대출제도에 대하여 법률조치를 취하고 있다. 이를 통해, 대출자(贷款人)가 대출 “적합성”원칙을 유지하고, 법정 및 약정의무이행을 책임지며, 대출자이 상환능력, 대출요구 및 목적, 위험등급 등에 대해 평가를 진행한다. 또한 부적합한 대출상품이 대출자에게 제공되지 않도록 보장하며, 나아가 효과적으로 위험을 통제하도록 요구하고 있다. 본 논문은 외국의 경험을 통하여 중국의 책임대출제도의 핵심의무와 법률책임을 고안하며, 중국의 공평하고 효과적인 책임대출제도를 구축하기 위한 방안을 모색하고자 한다.

负责任的贷款行为是借款人享有信贷福利的重要保障, 而不负责任的贷款却可能带来消费者的过度负债, 甚至成为金融危机的导火索. 为治理过度负债问题、预防经济危机、保护金融消费者利益, 许多国家根据本国国情对负责任的贷款制度进行了法律规范, 要求贷款人坚持贷款“适当性”原则, 负责任地履行法定和约定义务, 对借款人的还款能力、贷款需求和目的、风险等级等进行评估, 确保不将不适合的信贷产品提供给借款人, 进而有效地进行了风险防控. 本文拟通过借鉴域外经验, 对中国负责任贷款制度的核心义务、法律责任进行设计, 以期为中国建立公平、高效的负责任贷款制度提供裨益.
