A nation has to know the meaning of efficiency for guarantee and restriction of land property right. The term of efficiency is not used when the policy is made easily or carried it out. Rather, when people feel that guarantee and restriction of land property rights are done successfully, the term can be used. In other words, the developmental policy that is applied for nation and people is needed with guarantee and restriction of land property right guaranteed by the constitution. Now, guarantee and restriction of land property right that all people can accept has to be done with due process of law and principle of proportionality in principles of legislative.

토지재산권의 보장 및 제한을 위하여 국가는 효율성의 의미를 알아야 한다. 효 율성이란 국가정책을 쉽게 만들거나 실행하는 것이 아니라 토지재산권을 보장 및 제한하는데 있어 국민들이 느끼는 체감이 효율적이어야 한다는 것이다. 즉 헌법에 서 보장하는 토지재산권의 보장 및 제한을 함에 있어 국가와 국민 모두에게 적용 할 수 있는 발전적인 정책이 필요하다. 이처럼 토지재산권의 보장 및 제한은 입법원칙에 따라 적법한 절차와 비례원칙 등을 적용하여 국민 모두가 수긍할 수 있는 정책이 수립되어야 할 것이다.
