The United States Supreme Court Narrows Fourth Amendment Protection Despite Wide Public Distrust in Police

The Fourth Amendment protects people against unreasonable searches and seizures, only allowing warrantless searches in certain judicially approved situations. In Heien v. North Carolina, the United States Supreme Court expanded allowable warrantless searches to include those based on a mistake of law by law enforcement. Prior to this decision, a police officer’s search or seizure premised on his mistake of law was typically held unconstitutional. This new precedent will allow law enforcement officers to conduct searches despite the fact that no violation of law has occurred, as long as the officer had a reasonable misunderstanding of the law. The Fourth Amendment, similarly to most of the Bill of Rights, was enacted to protect people from excessive or improper government actions. In 2014, the political climate surrounding police interactions with people, specifically people of color, in The United States has been in a state of complete unrest. With continued concerns regarding racial profiling and the recent killings of unarmed civilians at the hands of police officers, there are many in the public that believe that more protection for the people is urgently needed. In addition to those who have expressed distrust and concern regarding racial profiling and systematic racism, many law enforcement officers are also dissatisfied the public discourse regarding these matters, expressing their concerns with counter protests and public statements criticizing politicians who show concern for those on the “other side” of this volatile court of public opinion. The Supreme Court has failed to address the obvious and blatant issues in the Criminal Justice system by releasing this opinion. This article will explain the history of the Fourth Amendment, the current issues surrounding warrantless stops, the Heien decision and the failure of the Supreme Court to engage in a the vitally important task of protection of the people.
