The rehabilitation in Germany start from understanding to a personal characteristic and living-condition by various question and council at beginning of the prisoners detained. From the perspective of restorative justice main purpose on the aftercare of the prisoners is to prevent recidivism and help rehabilitation to the society. Current German regulation provided for economical and psychological for released prisoner and for the family. First, that supports to released prisoner such as social reintegration back through the Rehabilitation Management with a variety of economic support money or a stable job placement Service. For family provides sustainable support for approach to help have a thorough grip of the various problems since the beginning of detained and until release from prison. In particular Germany correction Service concentrate on Main Streaming- Family correctional project for the released prisoner and for Family and develop various program for them. Recently in Korea have extended to support a wide variety of fields for released prisoner (plan), but however this target benefit of support limited. In addition Studies of support program for released prisoner is being progress continuously, while Family of a prisoner as the third victims despite of not victims is not taken care and study is incomplete. According to Germany’s Program, it is necessary for improving and developing of support Model based on suitable Korea’s sense of justice and legal system by Research of overseas advanced countries. Also Philosophy of rehabilitation should be reflected thereon.

독일의 법무보호는 수형자로서 형벌을 받기 시작하는 단계부터 개인의 특성 및 생활여건을 다각도의 질의 및 상담을 통하여 파악하는 것으로부터 출발한다. 회복적 사법정의의 관점에서 보면 출소자의 재범방지와 건전한 사회복귀를 돕는 것이 법무보호의 목적이라 할 수 있다. 현행 독일 법제는 출소(예정)자 본인과 그 가족에 대한 경제적·심리적 지원을 규정하고 있다. 먼저, 출소(예정)자에 본인에 대하여는 다양한 경제적 지원금, 직업소개, 사회복귀과정설계 등을 통하여 안정적 사회복귀를 지원한다. 출소자 가족에 대하여는 수형자의 수감시작부터 겪게 되는 다양한 문제를 파악하고 출소까지 지속적인 지원이 이뤄질 수 있도록 다각도로 접근하고 있다. 특히, 출소예정자와 그 가족을 대상으로 한 가족 중심 교정 프로젝트의 중요성과 다양한 프로그램 개발에 집중하고 있다. 최근 한국의 출소(예정)자 지원도 매우 다양한 분야로 확대되고 있으나 지원의 혜택을 받는 대상이 제한적이라 할 수 있다. 또한 출소자에 대한 지원 및 프로그램은 계속해서 개발되고 많은 연구가 이뤄지고 있으나, 피해자 아닌 제 3의 피해자라 할 수 있는 출소자 가족에 대한 지원은 그 필요성에도 불구하고 제도 및 연구가 미비하다. 독일의 법제와 출소자 대상 프로그램을 참고하여 한국의 행형현실에 맞는 출소자 및 그 가족 대상 지원 법제 및 프로그램을 개발하기 위한 다양한 연구와 노력이 필요하다.
