I try to explain that marketplace of ideas is able to be analogized through Korean history. In the perspective of general will we may analogize marketplace of ideas, we will understand that state community shall be erected by the decision of general will. The marketplaces of ideas which have been developed in ancient Greece and Rome, modern England, U.S.A. are not their own but are the common properties of human communities. On this premise I study this subject. First I try to scrutinize the approaches of J. Milton, J. Mill in England and Justice Holmes, Justice Brandeis, Professor T. Emerson, A. Meiklejohn, S. Ingber, V. Blasi and try to use for this study. First through the opening process of Ancient-Chosun we are able to enlighten that the general will of nation is congregated for free exchanges of ideas and state community building. This interpretation deserves to get the attention on the aspect of legal history and legal philosophy. This had been applied to Whabaek meeting, Sodo(Asylum) and the god mourning ceremony etc.. Under the rule of kingdom nations had tried to admit free speech and the communication to reflect the nation’s opinion and ideas. In the dawn of modern era Donghak Revolution is historic turning point for starting Korean democracy. And we may study Korean independent movement for recovering nation sovereignty that had been deprived by Japanese Militarism and may compare to that of U,S,A.. The marketplace of ideas might back up it in that it will be the space of self-decision of the nation’s path. The forefathers in that time preferred democratic republican system and abandoned constitutional monarchism. It was revolutionary change in the state mechanism and marketplace of ideas. While the marketplace of ideas is operated well, all members of nation are able to do their best. But it is not operated well, they are to splitted to partisanism and to confront national crisis. History often teaches us to understand this truth. Distorted information and fallacy will bring national crisis. The marketplace of ideas will enlighten Korean people as the sovereign.

우리의 역사 전체에 걸쳐서 사상의 자유시장을 유추할 수 있다는 점을 밝히려고 했다. 구성원 의 일반의지라는 측면에서 사상의 자유시장을 유추하고, 일반의지의 결단으로 국가공동체가 건 설되고 유지된다는 것을 이해할 수 있게 됐다. 고대 그리스와 로마에 이어 근대 영국과 미국에서 발전된 사상의 자유시장은 그들만의 고유한 게 아니라 인류공동체의 공통적인 요소가 있다는 점에 근거해 연구를 진행했다. 먼저 영국의 밀턴과 밀, 미국의 홈즈 연방대법관과 브랜다이스 연방대법관 그리고 에머슨과 마이클존, 잉버, 블라시 등 여러 학자들의 접근법을 깊게 성찰하며, 원용하려고 했다. 이 연구에서는 고조선의 개국과정을 살펴봄으로써 사상의 자유로운 거래와 국가공동체 건설 을 향한 전체 구성원의 일반의지가 작용한다는 점을 일깨우게 된다. 이 같은 연구는 법제사와 법철학적 측면에서도 의미가 있다는 판단이다. 이는 화백회의와 소도, 제천의식 뿐 아니라 현대 마을 공동체 운영 등 전체 역사를 통해 흐르고 있다. 왕정시대에도 지배체제는 백성의 여론, 사상을 반영하려고 언로, 표현의 자유를 일정 부분 인정하려고 한다. 우리의 근대 여명기로 볼 수 있는 동학혁명은 우리식의 민주주의를 태동시킨 역사적 전환점 이다. 또 일제로부터 침탈당하고 제한된 국권을 되찾으려고 한 독립운동은 미국 독립전쟁과 비견해 연구를 진행할 수 있다. 사상의 자유시장이 국가공동체의 운명을 스스로 결정짓는 결단 의 장이라는 측면에서 이를 뒷받침하는 것으로 보는 것이다. 독립운동기의 여러 선구자들의 사상을 보면 민주공화제로의 체제변혁을 선호한다. 이들의 투쟁과 전체 구성원의 의지가 결집돼 결국 독립을 이뤄내고 오늘날 자유민주주의 체제를 굳건히 할 수 있게 된다. 이와 반대로 식민사 관이 먹칠을 한 대로 해석한다면 우리는 사상의 자유시장을 상상할 수도 없을 뿐 아니라 외세에 의해서만 독립이 이뤄진 것으로 생각하게 될 것이다. 우리는 고조선 이래 독자적이고 독창적인 철학을 바탕으로 국가공동체를 유지해오고 있다. 그 힘의 원천이 사상의 자유시장의 기능으로 해석한다. 사상의 자유시장이 제대로 작동될 때 우리는 구성원의 모든 역량을 발휘하게 하고, 찬란한 문화를 일궈낸 바 있다. 그러나 사상의 자유시장이 제대로 작동하지 않을 때 당쟁에 휩쓸리고, 형식적인 명분론에 매여 국난을 자초하 기도 했다. 이는 역사가 연구자들에게 전하는 진리이다. 국가공동체 구성원이 활발하게 자신의 사상을 표현하고, 언론이 이를 정확하고 공정하게 전할 때 대한민국은 지속가능한 발전을 이룩 해나갈 것이다. 왜곡된 정보나 거짓은 국가공동체를 위기에 빠뜨릴 수 있다. 사상의 자유시장은 주권자로서 국민을 각성시키게 할 것이다.
