In 2006, ｢Business Bankruptcy Law｣was enacted in China, which was appreciated to draw the development and takeoff of market economy in China. Recent business bankruptcy regulation was qualitatively went up, compared with the existing one. Now, ten years after the enforcement of ｢Business Bankruptcy Law｣, considerable business bankruptcy cases were settled at courts, but a variety of problems come into exist. Mostly, they are due to the interpretation and application in principle of ｢Business Bankruptcy Law｣. So, Supreme People’s Court proclaimed many judicial interpretation and norms, as application standards of ｢Business Bankruptcy Law｣. Two judicial interpretation, performed in 2011 and 2013 respectively, are mostly related to the acceptance of bankruptcy application and the range and return of debtor’s property. It takes an important role in the practical affairs about ｢Business Bankruptcy Law｣ in China. So, this dissertation examines the recent tendency of business bankruptcy regulation, centering on two important judicial interpretation.

2006년 중국 ｢기업파산법｣의 제정은 중국 시장경제의 발전과 도약을 이끌어낼 수 있는 토대로 평가되었다. 또한 기존의 기업파산규제와 비교하여 상당한 질적 상승이 있었다. ｢기업파산법｣ 시행 이후 10여년이 지난 현재 상당 수의 기업파산사건이 법원에서 처리되었으나 다양한 문제점이 도출되고 있다. 그 문제점은 대부분 ｢기업파산법｣의 원칙적인 규정으로 인한 해석과 적용에서 나타나고 있다. 이에 중국 최고인민법원은 ｢기업파산법｣의 적용기준으로서 다수의 사법해석과 규범들을 공포하였다. 그 중 2011년과 2013년의 두 사법해석은 파산신청의 수리와 채무자의 재산범위 및 귀속에 관한 내용을 주로 하고 있는데 중국내 기업파산법 실무에서 중요한 역할을 하고 있다. 이에 본 논문에서는 주요 두 가지 사법해석을 중심으로 중국 기업파산규제의 최근동향을 살펴보았다. 중국의 기업파산규제는 중국 기업뿐만 아니라 중국 내 외국기업에게도 파산이 이루어지게 될 경우 채무자의 입장에서는 물론 채권자의 입장에서도 꼭 숙지해야 할 사항이며, 추가로 기업법인이 속한 지역의 기업파산 관련 지방성 규범에도 관심을 갖고 살펴볼 필요성이 있다.
