Summary: Taking the outbreak of passenger ship "SEWOLHO" sunken on 16 APR 2014 in the vicinity of Jindo island as the momentum, Korea Coast Guard was re-organized as an Office under Ministry of Public Safety in the effort to unify public safety missions which were separated throughout many divisions in Korean government and therefore, to be able to cope with every disaster on the land and on the sea. However, there are continuous confusions concerning on the jurisdiction, legal basis and range of mission of Korea Coast Guard. In this study, main objective is to clarify the definition on the characteristic, mission and jurisdiction of Korea Coast Guard and to suggest solution with the examination and analysis of domestic law and regulation, judical precedents and examples from other countries. From the result of this study, I found out that Korea Coast Guard's position as government division and the identity of the organization is vague due to the fact that 'Police' title were diminished in the mission descriptions and office titles although coast guard officers are still accomplishing law enforcement duties and therefore became demoralizing factor. The current maritime security situation requires, more than anytime, stronger law enforcement on the sea because of the growing needs for safety of Korean people after the "Sewolho" accident, the increasing maritime leisure activities of the people with their increasing income and the illegal fishing activities which are becoming more violent and intelligent. To cope with this situation, we need to prevent organization changes after every turnover of government, and to establish organization laws considering the identity and mission characteristics of Korea Coast Guard and the governing laws for appropriate maritime mission accomplishment tentatively called "Act on the Performance of Duties by Korea Coast Guard Officers" , and thus would be able to fortify maritime law enforcement. Also, we need to clarify the position of the organization as "Department" separated from the current "Ministry", prevent confusion of people with the coast guard station names unified with the missions, re-adjust investigation and intelligence missions for better support on search and rescue missions, and eventually improve mission specialty with definite position and jurisdiction of Korea Coast Guard.

2014년 4월 16일 전남 진도 앞바다에서 발생한 세월호 침몰사고를 계기로 각 부처에 분산되어 있는 안전 업무를 통합하고 지휘체계를 일원화하여 해·육상 모든 재난에 대응하기 위한 안전시스템을 구축하려는 정부 방침에 따라 해양경찰청은 신설되는 국민안전처 소속 해양경비안전본부로 개편되었다. 그러나 해양경비안전본부의 업무범위·법적지위·성격 및 관할권에 대한 논란이 지속적으로 야기되고 있다. 본 연구에서는 해양경비안전본부의 성격과 임무 및 업무 관할 등과 관련하여 관련법령, 판례 및 외국의 사례 등을 통해 문제점을 분석하고 이에 대한 개선방안을 제시하는 데 있다. 본 연구 결과 해양경비안전본부는 행정관청도, 보조기관도 아닌 행정기관으로서의 지위가 불분명하며, 경찰업무를 수행하고 있음에도 임무와 관서명에서 ‘경찰’이라는 용어가 삭제되어 조직 정체성에 혼란을 야기하고 조직원들의 사기저하 요인이 되고 있다. 세월호 사건 이후 안전에 대한 국민들의 요구가 높아지고 있으며 소득 수준 증가에 따라 해양에서의 레져활동이 급증하고 있고 갈수록 흉폭화·지능화 되고 있는 중국 등 외국 어선들의 불법조업 등 해양에서의 집행력 강화가 어느때 보다 시급히 요구되고 있다. 이에 적극 대응하기 위해서는 정권교체시 마다 소속이 변경되는 문제점을 바로잡고, 조직의 정체성과 업무 특성을 반영한 조직법과 해양에서 업무집행에 적절한 가칭「해양경찰관직무집행법」등 작용법 제정을 통해 해양집행력을 확고히 하여야 할 것이다. 또한 외청급 본부로 지위를 명확히 하고 업무와 관서명칭이 일치 하도록 하여 국민들의 혼란을 최소화하며, 안전․구난업무의 지원력이 강화되도록 수사․정보업무의 재조정을 통해 해양경비안전본부의 지위와 업무관할을 명백히 하고 전문성을 더욱 강화시켜 나가야 할 것으로 판단된다.
