The purpose of this study is to review the possibility of the control to the terms and conditions of the mobile phone service by Telecommunications Business Act and Act on the Regulation of Terms and Conditions. This study will allow enterprisers with efficient corporal management and cost reduction in costumer dissatisfaction or damage relief through improvement in the terms and conditions of mobile phone service. In addition the study may provide a basis for the related regulatory agency in regulation of terms and conditions of mobile phone service. The result can be summarized as follows. For an understanding by the costumers that the terms and conditions is the contents of the contract must be preceded and for the current terms and conditions has the possibility in hindering costumer benefits and inducing unfair contracts, this study first recommends new extensions and controls of the terms and conditions. Specifically this study suggested 1) the revision of ambiguous terminologies and contents of the terms and conditions or establishment of a standard terms and conditions, 2) introduction of obligations of Clear statements, explanation to the terms and conditions, and delivery of its copy to the customer, 3) the extensions of important contents of the terms and conditions to be need to explain. Specific articles, which were found to be possible to control under current legislations, related to the controls of the content for improvement include the article on subscription withdrawal of offers, the article on the obligation to notify the change in the contents of the terms and conditions, the article on the restriction of acceptance of application for utilization, the article on the change of the customer’s phone number due to the enterprise’s situation, the article on the period of notification service of the change of the customer’s phone number due to the enterprise’s situation, the article on the conditions on utilization suspension due to failure to pay bills and the period for notification in advance, the article on refund of over or wrong payment, the article on the period to raise objective on bills etc., the article on the obligatory possession of account data, the article on adolescent utilization contract-obligation of notification on cancellation of a contract without agreement of the legal representative, the article on the utilization of a adolescent exclusive contract, the article on the blocking of the source of harmful contents to adolescents, the article on blocking service and internet utilization bill notification service options.

본 연구는 이동통신 3사의 이동전화 서비스 이용약관을 전기통신사업법 제50조 제1항 제5호와 약관법 제6조에서 제14조까지의 규정에 의하여 통제 가능성을 검토하였다. 본 연구 결과는 기업측면에서 이동전화 서비스 이용약관 내용의 개선을 통하여 효율적인 기업 경영 및 소비자불만족이나 피해구제 등의 비용 절감을 가능하게 할것이며, 또한 관련 규제기관에 대해서 이동전화 서비스 이용약관 규제에 대한 근거를 제공할 것이다. 나아가 이동전화 서비스 이용약관을 소비자 지향적으로 개선함으로써 소비자의 합리적인 선택을 돕고 궁극적으로 소비자 권익향상에 기여할 것으로 기대한다. 연구결과는 다음과 같다. 우선 약관 편입 통제, 즉 소비자들이 약관이 계약의 내용이라는 인식이 선행되어야 한다는 측면에서 현행 이용 약관에 규정이 존재하지 않아 이용자의 이익을 저해하거나 불공정할 우려가 있어 난해한 용어 및 내용의 수정과 표준약관의 마련, 약관의 명시.교부.설명의무 규정 도입, 설명의무 대상인 중요한 약관내용의 확대를 제안하였다. 내용 통제 면에서는 청약철회 조항, 약관내용 변경 고지 의무 조항, 이용신청에 대한 승낙의 제한 조항, 회사 사정으로 고객의 전화번호를 변경할 수 있는 조항, 회사사정으로 고객의 번호 변경시 번호변경 안내서비스 기간 조항, 요금 미납시 이용정지 요건 및 사전고지 기간 조항, 과.오납 요금의 반환 조항, 요금 등의 이의신청 기간조항, 과금정보 의무보유 기간 조항, 청소년 이용계약 조항, 청소년 전용계약서 사용 조항, 청소년 유해콘텐츠 원천 차단 조항, 차단서비스 및 인터넷 이용요금 통보서비스 선택 조항이 현행법상 통제 가능성이 있는 것으로 나타나, 구체적인 문제제기 및 개선방안을 제시하였다.
