As we make the transition to a knowledge & information based society in this global environment, intellectual property is more important than ever before. The purpose of this study is to research about how to protect design right and execute design management to create the new culture and the advancement of the design area. In this study, theoretical and practical analyses of intellectual property rights are examined through literature reviews, yearly trends of industrial property are examined by processing intellectual property statistics and the flow of trends of design field is analyzed. The results of this study show that designs can be protected by intellectual property laws, represented as the design protection acts. Therefore, a suitable system can be chosen to protect designs in various conditions. Thus, designers should understand the legal aspects of design right laws in order to protect their intellectual property. Also developing a committee that would construct laws to assign intellectual property protection to design would be a significant step forward. This should protect creative design works, reflecting the changes in society and provide the opportunity for development in culture based creative design. It was concluded in this study that a more systematic and broader research in intellectual property rights for design is required.

지식정보화사회의 시대와 더불어 지식재산의 중요성과 경제적 가치에 대한 인식이 높아지면서 지식재산권은 그 범위가 확대되고 있으며 국가경쟁력의 전략적 수단으로써 그 가치와 중요성이 더욱 커지고 있다. 본 연구는 디자이너가 전략적으로 디자인보호시스템을 선택하는데 필요한 지식재산권의 의미와 분류, 현황 등 정략적 판단 기준에 대하여 살펴보고, 이를 통해 디자이너들의 법적권리에 대한 체계적인 전략과 이를 수행하도록 가이드 할 수 있는 디자인 지식재산권 정보 활용 방향을 모색하고자 하였다. 디자인지식재산권법과 제도, 지식재산권 현황에 대한 문헌조사와 통계자로 활용, 그리고 디자인관련회사에 대한 현황 자료를 조사하였다. 연구결과 디자인에 대한 법적 권리를 인정하고 이를 보호하기 위하여 지식재산권의 수렴과 실행을 위한 시스템이 필요하며, 아울러 디자인을 포함하여 지식재산의 범위를 이루고 있는 학문 및 실무 분야의 전문가를 양성하고, 디자인 분야 간의 공생적 협동이 필요한 것으로 나타났다. 향후 연구에서는 디자인에 대한 국내 법적 보호를 위한 구체적인 방안을 지속적으로 연구하여야 하며, 유럽이나 미국 등 외국의 입법례 및 판례 등에 대한 보다 광범위하고 체계적인 연구를 통해 좀 더 심도 있는 연구가 필요하다 판단된다.
