The issues on “Society of Fairness” and Justice has beenvery often treated in Korean society. The society of fairnessoffers equal opportunities to everyone, where he accepts theresult without claims. Concepts, such as ‘Fairness’, ‘Equalityof Opportunity’, ‘Justice’ are of great importance for theRawls’ theory of justice. It pursuits the justice which isrealizable through social structure or institutions. His theoryof justice which is summarized as the ‘Justice as fairness’,premises ‘original position’, ‘veil of ignorance’, ‘mutuallydisinterested rational human’. His theory which securesfairness through the procedure, is proved by two principlesbased on the serial or lexical order. Rawls stands firmly onthe line of the liberal tradition, which emphasizes on thepriority of the principle of equal liberty to the principle ofdifference. And the principle of difference which promotes the greatest benefit of the least advantaged among social members, reveals equalitarian aspects of Rawls’ theory of justice. Even though Rawls’ justice theory criticized theories of justice pursued by utilitarianism and extreme liberalism, it has its own limit. His theory has problems such as the rigidity of deontological ethics, the priority of liberty to equality, optimistic human theory, moral individualism. The solutions which overcome such limits, help us to build the theory of Christian Justice. From the Rawls’s view, it is hard to tell that Korean society is a fair society. It is not until the problems such as economic polarization, unequal education opportunity, unfair crimes in politic field and society will be solved, that Korean society will be able to be a society of fairness. And the basics of the theory of Christian justice - ethics in accordance with reality, interrelation between liberty and equality, Christian understanding of human, the value of community - will make Korean society much fairer than "society of fairness".

최근에 한국사회에서는 공정사회와 정의에 대한 주제가 회자되고 있다. 공정사회는 모든 사람에게 균등한 기회를 제공하지만 그 사회의 구성원들이 그 결과를 깨끗이 받아들이는 사회이다. 공정, 기회의 균등, 정의와 같은 개념은 롤즈의 정의론에서 매우 중요한 개념들이다. 롤즈의 정의론은 정의를 사회의 기본구조, 사회제도를 통해 현실사회에서 실현가능한정의를 추구한다. ‘공정으로서의 정의’로 요약되는 그의 정의론은 원초적입장, 무지의 베일, 상호무관심한 합리적 인간을 전제한다. 절차적 과정에서 공정성을 확보하는 그의 정의론은 축자적 서열의 원칙에 기초한 정의의두 원칙을 통해 확증된다. 차등의 원칙에 대한 평등한 자유의 원칙의 우선성을 강조하는 롤즈는 자유주의적 전통에 견고하게 서 있다. 사회구성원들가운데 최소수혜자의 최대이익을 도모하는 차등의 원칙은 롤즈의 정의론의 평등주의적 특징을 잘 드러낸다. 그러나 공리주의와 자유지상주의가 추구하는 정의론의 약점을 비판한 롤즈의 정의론에도 문제가 없는 것은 아니다. 그의 이론은 의무론적 윤리의 경직성, 평등에 대한 자유의 지나친 우선성, 낙관주의적 인간론, 도덕적 개인주의 등과 같은 문제를 갖고 있다. 이러한 문제를 해결하는 과정은 기독교정의론의 기초를 만드는 데 필요한 도움을 준다. 롤즈의 입장에서 볼 때 한국사회는 아직 공정한 사회라고 말하기는 어렵다. 경제적 양극화, 교육기회의 불평등, 정치와 공직사회의 불공정성과 같은 문제를 해결할 때 한국사회는 비로소 공정한 사회가 될 수 있을 것이다. 그리고 기독교정의론의 기초-현실적합성의 윤리, 자유와 평등의 상호관계성, 기독교적 인간론, 공동체적 가치-가 한국사회를 ‘공정사회’보다 더 공정한 사회로 만들 수 있을 것이다.
