The principle of due process of law is stipulated in the Article 12(section 1 and 3) of the Korean Constitution. The Due Process Clause in the Korean Constitution is thought to have originated from the principle of due process which had been developed to guarantee the basic rights of people in the countries of Anglo-American law. In the early 20th century, substantive due process was cited primarily for protection of property rights against encroachment by government. The U.S. Supreme Court's decision in Lochner v. New York, which determined that a New York state law limiting the maximum number of working hours of bakers was unconstitutional because it infringed on the freedom of contract is a striking example. The Court explained that right to contract is a fundamental right protected under the Due Process Clause of the Fourteenth Amendment and that this right could not be violated without serving a compelling state interest. And so began the Lochner era, an era of economic substantive due process. In Parrish, the Court upheld a state law mandating a minimum wage for women. Chief Justice Hughes cleary put an end to the Lochner era and raised a question of whether right to contract was protected under the Constitution. Upon achieving wide recognition that there did not exist freedom of contract in the Constitution, the Court's attitude to find freedom of contract as a fundamental right came to an end, and the idea of substantive due process itself was put on the inactive status. It was not until 1965 in Griswold decision that the Court finally began to shift to the modern idea of substantive due process, the protection of the fundamental rights. To cope with the still unsolved problems surrounding modern substantive due process, the Court should throw up its reliance on the history and tradition test in analyzing whether a right is fundamental or not. This article addresses many of the problems associated with the history and tradition test in the analysis of substantive due process doctrine, and provides the reasons why the Court should discard the test. And this article also maintains that the Court should pick out a balancing test weighing the interests of the individual in enjoying the right against the state interest in depriving the individual of his right.

우리 헌법 제12조 제1항 후문과 제3항은 적법절차의 원칙을 규정하고 있는데 이는 1987.10.29. 제9차 개정헌법인 현행헌법에서 처음으로 영미법계의 국가에서 국민의 인권을 보장하기 위한 기본원리의 하나로 발달되어 온 적법절차의 원칙을 도입하여 헌법에 명문화한 것이다. 적법절차의 원칙은 역사적으로 볼 때 영국의 1215년 대헌장(Magna Charta) 제39조, 1628년 권리청원(Petition of Right) 제4조를 거쳐 1791년 미국 수정헌법 제5조와 1868년 미국 수정헌법 제14조에 명문화되어 미국헌법의 기본원리의 하나로 자리잡게 되었다. 20세기의 첫 30여년 동안에는 실체적 적법절차원리는 주로 정부의 제한으로부터 경제적 자유를 보호하기 위하여 원용되었다. 두드러진 예로서 연방대법원이 제빵사들의 노동시간의 상한선을 정한 뉴욕주 법률을 계약의 자유를 침해한다는 이유로 위헌이라고 선언한 Lochner 판결을 들 수 있다. 연방대법원에 의하면, 계약의 자유는 수정 제14조의 적법절차조항에 의하여 자유로서 보호되는 기본적 권리이며, 이러한 기본적 권리는 국가가 오직 공공의 이익을 위해서만 제한할 수 있다. 그리하여 경제적 실체적 적법절차의 시대, 즉 Lochner 시대가 시작되었다. Parrish 사건 판결에서는 여성 근로자의 최저임금 보장을 의무화하는 주법을 지지하였다. Hughes 대법원장은 분명하게 Lochner 시대의 자유방임적 법학을 종식시키면서 헌법이 과연 계약의 자유를 보장하고 있는가에 대한 의문을 제기하였다. 계약의 자유와 같은 자유가 헌법에 보장되어 있지 않다는 사실이 인식되자 계약의 자유를 근본적인 자유로 인식하던 연방대법원의 태도는 종언을 고하게 되었으며 실체적 적법절차의 원리 자체도 휴면상태에 들어가게 되었다. 사생활의 보호와 다른 근본적인 권리가 문제된 1965년의 Griswold 사건에서 와서야 비로소 연방대법원이 현대적 실체적 적법절차의 관념으로 전환하였다. 현대의 실체적 적법절차 법리에 내재하는 미해결의 문제를 적절하게 다루기 위해서는 연방대법원은 어떤 권리가 근본적인 권리인가를 결정함에 있어서 역사와 전통 기준에 의존하는 태도를 포기할 필요가 있다. 이 글에서는 실체적 적법절차 원리를 분석하는 방법으로서 역사를 이용하는 방법이 야기하는 여러 문제점을 살펴본 다음 실체적 적법절차 관련 사건에 있어서 ‘역사’의 사용을 둘러싸고 발생하는 여러 문제점들을 적절하게 해결하기 위해서는 개인이 그 권리를 향유함으로써 얻게 되는 사익과 그것을 규제함으로써 얻게 되는 공익을 비교형량하는 이익형량 기준을 채택해야 하는 이유를 살펴보았다.
