According to the current law, public health doctors are under a double status; the status of a medical personnel under ‘Medical Service Act', and the status of a term serving public official under ‘State Public Officials Act’, in which the ‘State Compensation Act’ applies. If public health doctors cause harm, such as injury or death to patients by violating their duty of care, the legal liability of a public health doctor may be problematic. First, as a medical personnel, a public health doctor may be charged for breach of contract or tort on the civil liability side and involuntary manslaughter or injury by professional negligence on the criminal side. Second, a public health doctor's medical treatment as a public official, is considered as an act of agency. So, whether the state or local government should bear compensation liability, is another matter to be discussed. In the case of state compensation liability, the existence of state liability depends on whether a medical malpractice is gross or not. Accordingly, unlike general medical lawsuits, an additional judgment about the weight of the malpractice is necessary. Therefore, in the future, the debate on the weight of the malpractice is to be expected.

현행법상 공중보건의사의 신분은 의료법상의 의료인으로서의 신분 외에 농어촌의료법 규정에 의할 때 공중보 건의사는 국가공무원법상 임기제공무원에 해당하며 국가배상책임법의 규율대상인 공무원에 해당한다. 이러 한 지위를 지닌 공중보건의사가 의료행위를 시행함에 있어 주의의무를 위반하여 환자에 대하여 상해나 사망 등의 악결과를 발생시킨 경우, 공중보건의사의 법적 책임이 문제될 수 있다. 먼저 의료인의 지위에서 공중보건의사가 의료과실로 인한 환자에게 부담하게 되는 책임은 채무불이행책임이 나 불법행위책임으로서의 민사책임과 업무상 과실치사상죄로서의 형사책임이 문제된다. 다음으로 공무원의 신분으로서 공중보건의사의 의료행위는 기관행위에 해당하며, 국가나 지방자치단체가 공중보건의사의 의료 과실에 관한 국가배상책임을 부담하는 것이 별도로 논의될 수 있다. 국가배상책임의 경우 공중보건의사의 의료과실이 중과실인지 경과실인지에 따라 국가책임의 존부가 결정되 므로 일반적인 의료소송에서와 달리 추가적 판단이 필요하게 되며, 향후 의료과실의 경중에 관한 논쟁이 예상 된다.
