In fact, Little has given to the judical social welfare studies in korea academic world for criminal and victim contrary to the correctional social welfare studies development. In fact, America academic world and Japan one have approached about social welfare treatment for criminal and victim under "the forensic social welfare" from long ago. Thus, a good place to start is to know why judicial social welfare public production for them in the point of judicial social welfare and I would like to examin with the critical views "judicial welfare theory" which is published by YAMA GUJI(山口幸男) in japan 2005 and LEE MU WUNG in korea 2013. Existing studies of judical welfare have approached in the view of micro-program and non-interdisciplinary aspect about the treatment for them. Thus, in this paper I would like to show my original view about it contray to the existing theory.

우리나라에서는 교정복지학의 발달과 달리 범죄인과 피해자에 대한 사법복지공공재의 생산에 관련된 사법복지 학의 연구는 거의 없다고 할 수 있다. 사실상, 오래전부터 미국과 일본에서는 사법복지 (forensic social work)라는 명칭으로 사법복지적 접근이 이루 어져 왔다. 따라서 이 논문에서는 우리나라에서는 범죄인이나 피해자에 대하여 사법복지적 관점에서 사법복지공 공재의 생산에 접근해온 적이 없다는 사실을 지적하고 사법복지학의 비판적 발전을 위해 과거부터 현재에 이르 기 까지 일본에서 사법복지학을 주도하는 일본의 야마구치(山口幸男)의 저서인 “사법복지론”과 우리나라에서 출 간된 이무웅교수의 “사법복지론”이라는 저서에 대한 비판적 검토를 하고자 한다. 사법복지론에 대한 이러한 기 존의 선행연구들은 사법복지공공재의 생산에서 미시적 관점과 비학제적 접근을 하지만 본 연구에서는 학제적 접 근을 하고 기존연구와 다른 새로운 관점을 제기하여 한국의 사법복지의 방향을 제시하고자 한다.
