The European Union, consists of members from 28 countries, has been working actively now. Integrity of the European Union began in the Middle Ages, and May 5, 1949 the European Council had the modern sense by agreeing to form the first pan-European single institution. Since 1993, the European Union was established by the Maastricht Treaty, Croatia has recently become the 28th member of the European Union and was enlarged. After the organization of the European Union, the maintenance of private-law and the formation of the single market in the European Union were the continuous task of the European Union. In the private law sector, the European Contract Law establishing movement was begun by related jurists in the European Union. In addition to European contract law, the development of certain contract law sector such as the European Insurance Contract Law has already nearly 20 years research has been conducted. The official team created the framework of European Insurance Contract Law common provisions for the General rules section at the end of 2007 and it was submitted to the European Union. Also the particulars area was completed. The unifications of the European private law, particularly in the research work for the unification of insurance contract law would be a material that can be understood by a variety of cross-section of the judicial development of the future Europe. And it also makes sense to find the development direction of the direct and indirect methods to Korean law. The PEICL contains 6 Parts and 18 Chapters. It includes the general provisions that deal with almost all sectors of insurance, such as the fixed return insurance and indemnity insurance, except for the re- insurance. In particular, the PEICL deals with the specific insurances, also liability insurance, life insurance and group insurance, in which an insurer takes a quite substantial risk, such as the maritime or aviation insurance sector. The European scholars’ research and efforts for harmonization of European insurance contract law will be the great models to the Korean scholars when they discuss the amendment to the Korean insurance act, particularly on the point of insurace-consumer contract. Furthermore, it can be the important guidepost for designing a harmonized form of insurance law of two Koreas in the future after unification. Therefore, it will be worthy learning from the comments by the leading European scholars. Under the this writing, it will be just dealt with differency or special points between the Korean insurance act and PEICL from the perspectives of insurance-consumer contract. The detailed issues of PEICL will be studied deep into subject later.

유럽대륙에는 현재 28개국의 회원국으로 구성된 유럽연합이 활발하게 움직이고 있다. 많은 국가를 단일체인 연합 으로 만들어가는 태동의 역사는 단일유럽에 대한 관념의 형성기였던 중세에서부터 이미 시작하였지만 그것이 지 금과 같은 현대적 의미를 가지게 된 것은 1949년 5월 5일 유럽이사회가 최초의 범유럽적 단일기관으로 형성되는 것을 기점으로 한다. 이후 1993년 마스트리히트 조약에 근거하여 유럽연합으로 발족이 되었고 최근에 크로아티아 가 28번째 회원국으로 가입되면서 거대 유럽의 확대를 가져왔다. 이 과정에서 유럽 법문화에도 발전이 거듭되었 다. 유럽연합 이후 유럽연합에서의 단일시장의 형성을 위하여 사법질서를 정비하는 것이 유럽연합의 지속적인 과 제였다고 본다. 유럽에서의 입법적 통일화는 꾸준히 진행되었다. 일반법적인 측면에서의 유럽계약법 외에도 유럽보험계약법과 같은 특정분야의 계약법 발전도 이미 20년 가까이 연구가 진행되고 있으며 공식적으로 유럽보험계약법의 틀을 만 들어왔던 연구팀이 2007년 말에 총론부분에 해당하는 공통기준을 유럽연합에 제출하였고, 최근 각론부분까지 완 성한 상태이다. 유럽에서의 사법의 통일화, 특히 계약법 중에서도 보험계약법의 통일화 작업에 대한 연구는 향후 유럽의 사법 발전의 단면을 다양하게 이해할 수 있는 중요 자료가 될 것이며 직ㆍ간접으로 한국법의 발전방향을 모색하는 데에도 의미가 있으리라고 생각된다. PEICL은 전체가 6부 18장으로 구성되어 있다. 총론에는 보험계약 일반론을 담고 있고, 이어서 손해보험에 대한 일반규정과 정액보험규정 일반을 포함하고 있다. 각론에서 개별 보험제도를 제시하면서 책임보험, 생명보험 그리 고 단체보험에 대한 규정을 각각 두고 있다. 전체적인 구조는 매우 간결하지만 각 개별보험에 구체적인 규정을 담 고 있는 것이 특징이다. 유럽보험계약법을 통일시키기 위한 유럽연합 학자의 연구와 노력의 결과는 우리 보험계약법의 개정과 관련한 논 의, 특히 보험소비자에 관한 것에 의미있는 예시가 될 것이다. 다만 여기에서는 PEICL의 세부적인 쟁점보다는 소 비자계약적 측면에서 전체적으로 우리법과 다른 것이나 특이한 점을 중심으로 이를 개관을 하도록 한다.
