A Study on the Duty of Cargo Delivery of the Carrier in Voyage Charter

The purpose of this study is to examine the delivery duty of the carrier in a voyage charter, based on a comparative study of common law in U.K and Korean Commercial Law. The important differences between them are as follow. First, the delivery order is regarded as a legal transport document under English Law, whereas there are no express regulations and the consignee has no the right to make a claim on the cargo delivery in Korean Commercial Law. Second, the Letter of Gaurantee is generally regarded as illegal under English Law. Whereas there are no regulations in Korean Commercial Law. But if the Letter of Gaurantee is issued steadly, it is permitted as a legal document by commercial common law. Third, Personal delivery may be excused by the custom of the port or by express provisions of the contract under English Law. Whereas there are no regulations on the personal delivery under Korean Commercial Law but, there is the regulation that the master can deposit the goods to the court or can deliver the goods to the customs or any other place the authorities permit. Forth, under English Law there are the delivery standard on the mixing of goods caused by the excepted perils or the fault of the carrier. Whereas there are no regulations about the delivery of mixed or unidentifiable cargo under Korean Commercial Law.

기존의 항해용선계약상 운송인의 운송물의 인도의무에 관한 논문은 주로 선하증권이 발행된 경우, 또는 발행되지 않은 경우에 대한 연구는 있어 왔으나 양륙항에서 수하인이 운송물청구를 위하여 운송물수령을 게을리 하거나, 거부하는 경우, 나아가 운송물이 다른 수하인에게 인도될 유사한 운송물과 함께 선적되어, 항해 중에 그들의 식별성을 상실한 경우 등의 문제에 대한 연구는 미흡하였다. 따라서 본 논문에서는 기존의 연구된 부분을 포함하여 수하인의 운송물 미수령의 경우, 혼합운송물의 인도문제에 대한 연구를 영국보통법을 중심으로 하여 상법의 관련 규정을 함께 비교·검토하여 그 기준을 제시하고자 한다.
