Since Modern constitutionalism constitution has established, it has been the most important value to secure maximised freedom and rights of citizens. It implies modern constitution does dispersion of governmental authorities. The fact that governmental power is not concentrated has enabled each institutions to exercise its own power, and the constitutional agreement of 'power separation' could have become a constant and technical system that guarantees citizens' freedom and rights because each governmental institutions do power checks and balance to each other. As a result of people's revolution such as French revolution, it inspired people that most important factor is to have freedom from the nations according to liberalism thoughts during 18th to 19th century. In 20th century, economic and social rights of weak people was codified in the 'Weimar constitutions' followed by Russian revolution. Later 20th century, this phenomenon was strengthened and it was showed by a rise of 'freedom of speech' or 'rights of hold a public office'. Additionally, the idea 'dignity of individual rights' has been considered valuably in each nations' constitutions after Second World War. It was influenced by the tragic sacrifice of Jewish victims. Since the tragedy, Human Right idea has became more concrete globally. Since later 20th century, 'Information society' has oriented, and also solidarities between nations and even individuals has emerged. Those new changes mostly aim for the idea of Human Right. Nowadays, individual freedom and rights are not only factors to consider anymore. Also the factors such as symbiotic relationships, peace, environment and solidarity are significantly considered. Our country is not an exception. 'Advisory committee for constitutional reform' under the 19th chairman of National assembly which was over on 29th May 2014 showed its bill for constitutional revision. The recent international trend of Human Right codification can be found in its bill for amendment. The system of 'Human Right' exists throughout our modern history. How should it be reformed in order to prepare 'Unification of Korean peninsula'? The comparison between European Union’s Charter of Fundatental Rights and our 'Advisory committee for constitutional reform of National Assembly' will be highly meaningful for such demonstration.

근대입헌주의 헌법에서 가장 중요한 이념은 국민의 자유와 권리의 최대한 보장, 그리고 그 자유와 권리를 보장하기 위해 권력을 분산시키는 것이었다. 시민혁명의 결과 18-19세기에는 자유주의 역사관에 따라 국가로부터의 자유를 가장 중요시해, 주관적 공권으로서의 기본권이 처음으로 憲法典化되었다. 20세기에는 러시아혁명 등의 영향으로 경제적·사회적 약자의 권리(통칭 사회적 권리)를 보장해 주기 위한 시도가 바이마르헌법을 기점으로 시작됐다. 바 이마르헌법은 시대적 배경이나 내용적으로 볼 때 ‘자유주의에 대한 반동의 역사’ 또는 ‘자유민주주의 헌법에의 사회 주의 이념 수용’이라고도 할 수 있지만, 결국은 이 또한 인간의 자유와 권리를 최대한 보장해 주기 위한 제도적 장치 였다고 할 수 있다. 20세기 초중반부터는 기본권의 공적 기능이 인정되면서 민주주의와 관련된 표현의 자유 또는 공무담임권 등이 부각되기도 했다. 제2차 세계대전 이후에는 나치에 대한 반성으로 인간의 존엄성 존중이 각국의 헌법적 가치로 확고하게 자리매김했고, 인권의 보편성을 바탕으로 인권의 국제화가 공고해지고 있다. 예컨대 국제 연합(UN) 등 국제기구를 중심으로 체결되는 각종 인권협약에 비준 및 가입하는 국가에 대해서는 이행의 의무가 부 가되고 있고, 이같은 국제인권협약은 ‘일반적으로 승인된’ 국제협약으로서 위반 시 일정한 제재가 가해지기도 한다. 인권의 실질화를 담보하기 위한 이같은 국제연대(國際連帶)는 20세기 후반 정보화 사회가 대두하고, 국제화·세계화 가 진행되면서 대외적으로 국가들끼리의 연대만이 아니라 국내적으로 개인적인 연대도 강화·강조되고 있다. 우리 나라도 예외가 아니어서, 지난 2014년 5월 29일로 종료된 제19대 국회의장 직속 헌법개정자문위원회가 마련한 개 헌안(이하 ‘개헌안’이라 축약한다) 가운데 기본권 부문에서 이같은 변화를 찾아 볼 수 있다. 本 논문은 헌법의 기본권체계(Grundrechtssystem)의 변화가 역사적으로 어떤 의미를 가지며, 역사의 발전단계에 서 어떻게 변모해 왔고, 헌법이 한반도 통일과 세계평화에 이바지하기 위해서는 기본권체계가 어떻게 달라져야 하 는지를 현행헌법과 개헌안을 유럽연합(이하 ‘EU’라 한다)의 기본권헌장과 비교해 논함으로써 헌법의 기본권체계가 초래하는 현실적합성을 논증해 보고자 한다.
