독일의 이산화탄소 포집‧저장에 관한 법률

The reduction of greenhouse gas which is caused by the climate change becomes an common challenge of the world including our country. To reduce the greenhouse gas, the proportion of carbon dioxide should be reduced, which amounts for most greenhouse gases. The world is making efforts to reduce fossil energy which is one of the causes of mass carbon dioxide, to use recycled energy which can replace the fossil energy and to reduce the use of energy. However, the most practical way to reduce the greenhouse gas is to capture and store the carbon dioxide(CSS). Even the European Union has decided CCS as a significant alternative to reduce the carbon dioxide emission at least 50% by 2050 and enacted 「CCS guideline (CCS-Richtlinie 2009/31/EG)」 to construct an institutional framework required to make positive utilization of CCS technology. Accordingly, the members of the European Union including Germany were forced to enact a law to implement this guideline. In spite that Germany has set their direction to “Energy transformation”, Germany was fully aware that they cannot give up to produce electricity using fossil energy in the future energy mix. Consequently, the only solution to reduce carbon dioxide while providing energy stably is CSS. Under this background, Germany has prepared an institutional framework that can contribute to reduction of greenhouse gases by enacting 「Act on the application and test of technology for capture, transportation and permanent storage」 to implement 「CCS guideline」 in 2012. 「Act on the CCS」 consists of total 7 chapters and 46 provisions specifying research, test and pilot business of technology to store carbon dioxide in the underground bedrock. Specially, the Act mainly regulates permission of storage of carbon dioxide. It is because that strict discipline is required as the technology and safety of storage were not proven compared to the capture and transportation of carbon dioxide. The Act includes provisions for transportation permission, damage liability and compensation guarantee of carbon dioxide except the capturing facility of carbon dioxide which is subject to the 「Federal Immission Act」. Germany constructed a framework to test CCS technology by enacting 「Act on the CCS」. As the risk of CCS technology comes into play, however, needs to solve this issue are increasing. The enterprises are supposed to have economic burden of CSS technology as they should bear the installation cost of capturing facility, operating cost of storage, damage liability for the accident and maintenance cost. Nevertheless, the Act is exploring a way for the public to participate in the CCS related project to increase the social acceptance of CCS. In the point that the reduction of carbon dioxide is an immediate international responsibility which our country cannot avoid, the implication of 「Act on the capture & storage of carbon dioxide」 which proposed legislative method to CSS technology would give significant meaning.

기후변화의 원인으로 지목되고 있는 온실가스의 감축은 우리나라를 비롯한 세계 각국의 공통적인 과제라 할 수 있 다. 온실가스감축을 위해서는 인위적으로 배출되는 온실가스 중 가장 많은 비중을 차지하고 있는 이산화탄소를 감 축하여야 한다. 세계적으로도 이산화탄소의 대량 배출원인 화석에너지의 소비를 줄이고, 화석에너지를 대체할 수 있는 재생에너지를 사용하거나, 에너지의 사용을 줄이기 위하여 에너지효율성을 증대하려는 노력을 하고 있다. 그 러나 현재 사용되는 화석에너지를 가능한 줄이지 않으면서도 온실가스를 감축할 수 있는 가장 현실적인 방안은 이 산화탄소의 포집‧저장(CCS)이다. 유럽연합도 2050년까지 전세계 이산화탄소 배출량을 최소한 50%로 감축하기 위한 중요한 대안으로 CCS를 결정하 였고, CCS 기술의 적극적 활용에 필요한 제도적 기반을 구축하기 위하여 2009년 「CCS 지침(CCS-Richtlinie 2009/31/EG)」을 제정하였다. 이에 따라 독일을 포함한 유럽연합의 회원국은 이 지침을 자국의 법률로 이행하기 위 한 법률을 제정하여야 하는 상황에 놓이게 되었다. 독일도 에너지정책의 방향을 “에너지전환”으로 설정하였음에도 불구하고, 미래의 에너지믹스에서 화석에너지를 사용한 전기생산을 포기할 수 없음을 충분하게 인식하고 있다. 결 국 에너지를 안정적으로 공급하면서도 이산화탄소를 감축할 수 있는 유일한 해결방안으로 CCS를 고려할 수밖에 없다. 이러한 배경하에서 독일은 2012년 「CCS 지침」을 이행하는 「이산화탄소의 포집, 수송 및 영구적 저장을 위한 기술의 시범과 적용에 관한 법률」을 제정하여 온실가스의 감축에 기여할 수 있는 제도적 기반을 마련하였다. 독일의 「이산화탄소 저장법」은 총 7장 46개 조문으로 지하암반층에 이산화탄소를 저장하기 위한 기술의 연구, 시험 및 시범사업에 관하여 규정하고 있다. 특히, 동법률은 이산화탄소 저장소의 허가에 관한 사항을 주된 규율대 상으로 하고 있다. 이산화탄소의 포집이나 수송에 비하여 저장에 관한 기술력과 안전성이 충분하게 검증되지 않아 보다 철저한 규율이 필요했기 때문이다. 동법률은 「연방임미시온방지법」의 적용을 받는 이산화탄소 포집시설의 허가 이외에 이산화탄소의 수송허가, 피해배상책임과 피해배상보장 등에 관한 사항을 포함하고 있다. 독일은 CCS 법률의 제정을 통해 CCS 기술을 시험할 수 있는 기반을 구축하였다. 그러나 CCS 기술이 가지는 위험 성에 대한 문제는 더욱 부각되고 있어 수많은 문제해결에 대한 요구를 받고 있다. 기업은 이산화탄소 포집시설의 설치비용, 저장소의 운영비용, 사고발생에 대비한 손해배상비용 및 사후관리비용을 부담하게 됨으로써 CCS 기술 의 경제성에 대한 부담을 가지고 있다. 그럼에도 불구하고 CCS의 사회적 수용성을 증대하기 위하여 동법률은 CCS 관련 사업에 일반국민들이 참여할 수 있는 방안을 모색하고 있다. 이산화탄소의 감축은 우리나라도 피해갈 수 없는 당면한 국제적 의무라는 점에서 CCS 기술에 관한 입법적 방안을 제시한 독일의 CCS 법률이 주는 시사점은 큰 의 미가 있을 것이다.
