A fire fighting facility is an important facility that protects people's lives and property from disaster or fire. The qualifications and requirements for companies are stipulated in fire service laws so that the fire fighting facility shall be surely constructed by registered companies which have expert knowledge and technology because of special characteristics of the facility that requires safety and accuracy. However, at present, the actual condition is that total construction companies receive turnkey-based orders for most of construction work. This paper is intended to present the validity and justification of introducing a separate order system in firefighting facility construction after reviewing a separate order and current turnkey-based order to undertake construction by subletting a construction project for which a prime contractor receives an order, including a joint contract. In order to accomplish this purpose, it is intended to analyze Korean legislation about firefighting facility construction and to present a plan for improving the current legislation so as to introduce a separate order system to firefighting facility construction. To this end, a research method from the perspective of comparative laws was used at the same time, which reviews legislation on separate order in foreign countries that enforce laws on separate order in public works.

소방시설은 재난이나 화재 시 국민의 생명과 재산을 보호하는 중요한 시설로서 그 시설의 안전성과 정확성이 요구되는 특수성 때문에 전문적인 지식과 기술을 갖춘 등록된 업자가 반드시 시공하도록 소방법령에서 그 자격 및 요건 등을 규정하고 있으나 현재 대부분의 건설공사는 종합건설업체에서 일괄 수주하는 실정에 있다. 본 논문에서는 소방시설공사 발주방법에 있어 공동도급을 포함한 원도급자가 수주한 공사를 하도급하여 시공하는 현행 일괄발주와 분리발주의 장단점을 검토한 다음 소방시설공사에서의 분리발주제도 도입의 타당성 및 당위성을 제시하고자 한다. 이러한 목적을 달성하기 위하여 우리나라의 소방시설공사에 관한 법제를 분석하고 소방시설공사에서 분리발주제도를 도입하기 위한 현행 법제의 개선방안을 제시하고자 한다. 이를 위해 공공사업에 있어서 분리발주를 시행하고 있는 외국의 분리발주법제를 검토하는 비교법적 연구방법도 병행하고 있다.
