For the legislative studies, legislative evaluation has become one of the essential instruments in seeking for ‘good law’. Considering the limitations of human’s recognition ability, it is impossible to make an impeccable decision without the help of balanced and rational evaluation tools. This paper, focusing on the bill compensating for the child soldiers taking part in the Korean War at the age below 18-years, tried to evaluate the legislation of compensating for the war veterans of national merit according to a few critical criteria. First, the paper evaluated the bill on the necessity of compensation, based on if there was a special sacrifice or contribution differing from that of the other type of war veterans. Second, on the ways of compensation, it enlightened if such a bill tackling special groups apart from the whole war veterans would come with both the principle of veterans affairs and the framework of those existing various veterans acts. Lastly, it considered the bill in the aspects of the possible results on the supposition that it is implemented well. Presumably it is expected that the bill would raise the issue of equity from the other veterans and furthermore affect the national budget adversely. Legislative evaluation in this case does not substitute for the democratic decision in the National Assembly of Korea. However it will provide unbiased and rational data to the decision making process, eventually leading to a better convincing law.

좋은 법률을 추구하는 입법학 연구에 있어서 입법평가는 필수불가결한 수단이 다. 인간의 인식능력의 한계와 집단적 의사결정의 내재적 한계를 고려할 때 객관적 이고 합리적인 분석 내지 평가 없이 훌륭한 의사결정을 기대할 수 없기 때문이다. 다만, 현대국가에서 입법영역이 워낙 다양하여 모든 입법에 있어서 동일한 평가기 준이 적용되거나 강조될 수는 없으므로 법률 내용에 따라 고유의 평가기준이 마련 되고 적용되어야 할 것이다. 이 글에서는 현재 국회에 계류중인 6･25참전 소년소녀병에 대한 보상입법을 중 심으로 보훈입법에 대한 평가를 시도해 보았다. 보훈입법에서 특별히 중시되는 평 가기준으로서 우선, 입법(보상)의 필요성과 관련하여 특별한 희생과 공헌이 있었는 지를 평가해 보았다. 다음으로 보상의 방식과 관련하여 개별 보상입법을 추진하는 것이 보훈입법의 원칙과 기존 보훈법령의 체계와 부합하는지에 대한 평가를 해 보 았다. 끝으로 입법의 결과로서 형평성 측면에서 여타 참전유공자에게 미치는 영향 과 재정적 측면에서 국가에 미치게 될 부담에 대해서도 평가해 보았다. 이 글에서의 입법평가가 국회에서의 민주적 의사결정을 대체하는 것은 아니다. 다만, 국회 입법심사 과정에 객관적이고 합리적인 분석 자료를 제공함으로써 보다 설득력 높은 의사결정을 유도할 수 있다는데 그 의의가 있다고 할 것이다.
