From the institutional perspective, this study examines whether the law school system that was introduced in 2009 has been running in compliance with the inaugural objectives. To achieve this goal, a panel consisting of five law school professors and five lawyer alumni analyzed the current status of law school management, focusing on how law schools have been responding to changes in the environment. The results are summarized as follows: First, of the various institutional environments influencing law school management, those confirmed to be critical were the quota-controlling bar examination system, regulations related to the foundation of the law school and management evaluations, the remuneration trend of legal personnel, lawyer selection practice, and the rankings among law schools. Second, such institutional environments have compelled law schools to adopt substantial self-imposed constraints associated with curriculum management. Third, the uncertainty of a safe environment for the continuation of the current law school system was found to be a barrier for achieving the inaugural objectives of the law school system, and for furthering specialization-related development. Some policy implications are suggested based on the above findings.

이 연구는 지난 2009년 출범한 법학전문대학원(이하“로스쿨”)이 당초 제도 도입 취 지에 얼마나 부합되게 운영되고 있는 지를 제도주의적 관점에서 살펴보는데 목적이 있 다. 이를 위해 로스쿨 교수 및 로스쿨 출신 변호사 각 5명을 선정하여 로스쿨들이 제 도적 환경과 그 변화에 어떻게 대응하는 지를 살펴보았다. 심층적 포커스 그룹 면담 분석 연구 결과, 다음과 같은 결과를 얻을 수 있었다. 첫째, 여러 제도적 환경 중에서 로스쿨 교육에 중대한 영향을 미치는 것들로서 정원통제형 변호사시험제도, 인증제를 기반으로 한 로스쿨 설치, 로스쿨 운영평가에 관한 각종 민관 규제, 대형 로펌의 변호 사 선발 관행, 로스쿨 간 서열화 등이 도출되었다. 둘째, 로스쿨들은 이러한 제도적 환 경의 영향으로 인해 특성화적 발전보다는 과거식 ‘수험법학’으로 회귀하는 경향을 보이는 등 상당한 교육과정운영 상의 제약을 받고 있었다. 셋째, 현행과 같은 로스쿨 제도가 과연 지속할 것인지에 관한 환경적 불확실성이 로스쿨의 도입 취지를 제약하 고, 자율적이고 특성화된 발전에 장애가 되고 있는 것으로 나타났다. 이상의 결과를 바 탕으로 몇 가지 정책적 시사점을 제언하였다.
