Security Services Act is the law associated with the Private Security intended forthe limit of work such as health growth, property of the people and self-protectionresponsibility by privatizing the Security Services on several individual danger notdepending on governmental power because of the limit of Public Security Servicebetween the country and police. This study presents to discuss the revision direction to make effective courses,considering the condition of affairs about a number of problems for the SecurityServices Act. Firstly, In this paper, The deregulation of the session should be discussed thepermission of the guard disposition and the permit system within 48hours. Police thatis responsible for the maintenance of public order have troubles intervening in aprivate area directly despite having a problem of the security. People don't beguaranteed the social right promptly when people and corporation need to the privatesecurity in the waiting time for the arrangement. Thus, whatever it may happen, whenpeople and corporation are in danger completely, setting the time is a regulationagainst the effective security business that people need owing to having a right to beprotected as a beneficiary. Secondly, the regulation disposition about a guard instructor in site of the collectivepetition can be realized. It is under difficult to understand a shortage, business surplusand daily employment of the guard instructor. According to a situation of modernsociety needed a social responsibility, the solution needs it is that a executiveparticipates in himself directly, how to run the security services, and how to seek forthe use the personal guard as a recognized qualifications to specialize. Thirdly, The temporary guard system should be introduced. It would be helped toimprove the manpower problems solution under small and low wages in some securitybusinesses. It expects to help that the students take part in the social activitythemselves that the specialist gets a job at the national level. Lastly, The education for security guard should take effect practically. Judging froma high turnover and poor working condition, the guard business needs to get the timeto prepare itself and the conditions to implement the new law.

｢경비업법｣은 국가와 경찰의 민간 치안서비스의 한계로 공권력에 의존되지 못하는 각종 사적 위해상황에 대한 경비업무가 민영화됨에 따라 민간경비의 건전한 육성과 국민의재산 과 신변 보호업무 등의 업무상 한계를 정하여 만들어진 민간경비와 관련된 일체의법이다. 본 연구는 현행｢경비업법｣이 가지는 다수의 문제 조항에 대하여 실무상황을 고려하여효율적인 방향으로 개정방향을 논의하고자 하는데 목적이 있으며, 개정방안은 다음과 같다. 첫째, ‘집단민원현장’의 경비원배치 허가와 48시간 이전 배치허가제 등 이중규제 중 시간의 규 제완화에 대하여 논하고자 한다. 공적 질서유지 업무를 담당하는 경찰이 치안공백을 두고 사적 영역의 직접 개입이 힘든 현실, 그리고 배치허가 대기시간에 국민과 기업에 민간경비를 필요로 하는 상황이 발생하였을 시 국민은 즉각적인 서비스를 제공받지못하게 됨으로써 사회적으로 정당한 권리의 보장이 좌절될 수 있다. 그러므로 어떠한 상황이든 국민과 기업은 위급함을 느 낄 때 수익자의 입장에서 당장 보호받을 권리가 있으므로 시간을 정함은 국민이 요구하는 효율 적인 경비업무에 반한 규제라 할 수 있다. 둘째, 집단민원현장 등 경비지도사 배치 규제에 현실화가 요구된다. 경비지도사의 부족현상의 이해, 경비지도사의 업종별 쏠림현상과 단일ㆍ일용고용이 어려운 현실이다. 따라서 책임주의 를 요구하는 현대사회 분위기에 따라 법인임원 당사자의 직접참여와 교육으로 안정된 경비업 의 운영을 도모하는 방법 또는 최근 공인 자격으로 인정된 신변보호사활용 등의 방법을 모색하 여 전문화에 기여할 수 있도록 대책을 강구하여야 할 것으로 보인다. 셋째, 준 경비원제도를 도입하여야한다. 영세함과 저임금화 되어있는 경비업 일부업종의 인력 난 개선효과, 학생들의 정당한 사회활동과 직접참여 유도, 나아가서는 국가적 차원으로 전공자 의 취업증진에도 도움이 될 것이라 본다. 마지막으로 경비원 신임교육이수를 현실화하여야 한다. 높은 이직률과 영세성을 고루가진 경 비업의 사정을 고려하여 경비업자에게 준비할 수 있는 시간 및 개정된 법 이행을위한 여건조성 이 필요하다고 본다.
