The confrontation between developers of public works and local residents has become a controversial issue. Such conflict is not a recent issue but has been there for a long time and related to a range of subjects. There have been diverse efforts in terms of policy and legislation to prevent any dissension in advance and to resolve them. Nonetheless, discord arising from public works or public policy has not been reduced but become more of a social issue. Public conflict arises out of a disparity in the understanding between a government and the public, which can deteriorate public trust in government. Stronger partnership between a government and the public is essential to recover public trust in government and to minimize social loss caused by public conflict. This study reviews Japan’s public participation system in order to prevent public conflict regarding public works and furthermore to improve the completion of policy formulation and policy-making through cooperation between policy makers and the public. Japan stipulated a public hearing procedure upon the amendment of 2005 Administration Procedure Act to eliminate public distrust on policies through recovering transparency and trust on administrative operation and to have the public to participate. Moreover, Japan established and implemented ‘A Planning Process Guideline on Public Works Initiatives’ on April 2008 to encourage public participation in public works. Korea has tried to lay a legislative foundation on promoting public participation in a policy making process through amendment of the current administrative procedure law. There is a new perspective on a way to prevent public conflict, which looks that communication between policy makers and the public and public participation throughout a formulation and a process of public works may minimize social conflict. In order to achieve more active public participation in public works, a government, a key player of making a policy must provide the public with accurate information, allow easier access for the public to a policy making process, and embrace voices of all walks of life. It is imperative that the public must participate proactively in a discussion on policy formulation and policy making to voice their opinions on a policy that can influence their lives instead of using it for their own interest.

공공사업의 시행 등과 관련하여 사업주체와 지역 주민 간의 마찰이 사회 적으로 문제시 되고 있다. 물론 이러한 마찰, 갈등은 오늘에 국한된 현상은 아니라 종전에도 발생하였으며 그 대상도 다양하다. 이러한 갈등을 사전에 예방하고 발생한 갈등을 해소하기 위하여 정책적ㆍ법제도적으로 무던히 노력 하고 있다. 그럼에도 불구하고 공공사업 내지는 공공정책과 관련한 갈등 발 생은 감소의 일편을 걷는 것이 아니라, 사회적 현안과제로 되고 있다. 이러한 공공갈등의 사회적 문제는 정부와 국민 간의 갭에 기인하며, 이것은 정부 신 뢰의 위기로 작용한다. 정부의 신뢰를 회복하고 공공갈등으로 인한 사회적 손실을 최소화하기 위해서는 정부와 국민의 파트너십의 강화가 절실히 요구 된다. 이 논문은 공공사업과 관련한 공공갈등의 예방 나아가 정책추진자와 국민 의 협치ㆍ참여에 의한 정책형성 및 정책결정의 완결성을 높이기 위해 일본의 국민참여제도를 고찰하였다. 일본의 경우 행정운영의 투명성과 신뢰성을 확보하여 국민의 정책 불신을 쇄신하고자 하는 취지와, 행정운영에의 국민을 직접참여 시킴으로써 정책의 완결성을 높이기 위해 2005년 행정절차법 개정 시 의견공모절차를 명문화하 였다. 또한 공공사업에 국민참여를 활성화하기 위한 방안으로서 2008년 4월 에 공공사업 구상단계의 계획책정 프로세스 가이드라인 을 작성하여 현재 시행 중에 있다. 우리도 현재 행정절차법의 개정 등을 통하여 정책과정에의 국민참여를 활성화하려고 법제도적으로 그 기반을 마련하고 있다. 그리고 공 공사업의 갈등 예방ㆍ해결에 대한 새로운 인식, 즉 공공사업의 형성 및 과정 에 정책추진자와 국민이 서로 소통하고, 직접 참여할 수 있도록 제도화하는 방안이 사회적 갈등을 최소화할 수 있을 것이라는 관점에서 공공사업의 국민 참여 활성화에 노력하고 있다. 공공사업에 국민참여 활성화의 결실을 위해서는 정책추진 주체인 정부는 국민에게 정확한 정보를 제공하고, 정책과정에의 접근 용이성과 국민의 다양 한 목소리를 포용할 수 있어야 한다. 또한 국민은 정책형성 및 과정에 토의 와 정책방안 제언을 자신의 이익을 위한 논의의 장으로 이용하는 것이 아니 라, 자신의 삶에 영향을 미치는 정책에 자신들의 목소리가 반영될 수 있도록 능동적으로 참여한다는 자세가 선결되어야 할 것이다.
