The purpose of this study was to analyze the educational issues on the State’s involvement and Mechanisms of the Administrative Acts and Accountability of Superintendents of Education. The findings were as follows. First, the educational issues of the administrative acts and the accountability types of the superintendents of education were derived from ambiguous provisions in the concerned rules and regulations resulting in different points of view between the state and the superintendents of education. Second, These conclusions set the course for further study clarifying the role of superintendents as prescribed in educational laws. Follow-up studies are needed to determine steps to reduce conflict between the state and the superintendents. Such work could examine the administrative acts in line with customer-driven accountability for superintendents.

본 연구는 교육감의 행정행위와 책무성에 대한 국가의 관여 방식과 기제에 관한 쟁점을 분석하기 위해 수행되 었다. 이와 같은 목적을 달성하고자 교육감과 교육부장관 사이에 가장 쟁점이 된 아홉 가지 사례를 분석하였 다. 본 연구의 결론은 다음과 같다. 교육감의 행정행위와 책무성에 대한 쟁점은 교육감의 행정행위에 대한 불명확 한 법규 내용과 그에 따른 국가와 교육감의 인식 차이에서 비롯되었다. 교육감의 행정행위에 대한 국가의 관 여는 행정적 관여가 주류를 이루었지만 행정적 관여로 쟁점이 해결되지 않으면 사법적･입법적 관여를 통해 교 육감의 행정 행위에 관여하고 있는 것으로 나타났다. 또한 교육감을 평가하는 책무성에 대한 국가와 교육감의 인식의 차이에 의해서 쟁점이 발생하였다. 그리고 이러한 양상은 지역주민의 여론에 의해 가장 큰 영향을 받 고 있었다. 본 연구의 결론을 바탕으로 몇 가지 제언을 한다면 다음과 같다. 첫째, 교육감의 권한에 관한 모호한 법규 내 용 정비가 필요하다. 둘째, 자치사무와 재량행위의 범위및 내용과 방식 등을 담고 있는 관련 법령 개정을 위한 후속연구가 필요하다. 셋째, 고객지향적 책무성에 초점을 두는 국가의 관여 방식을 재고할 필요가 있다.
