The judicial participation by the nation, in other words, that people join the process of judicial trial and come to the judgement and declare in association with the professional judge, it represents the significance in actualizing the democracy and the legal state governed according to the law. The people’s judicial participation is on the basis of the provision 1(2) of Constitution “every power comes from the people” and the provision 27 (1) “every nation has the right to receive the judicial trial according to the law and it is available only by the judge appointed on the Constitution and the law.” Since the modern type of judicial institution had been brought in Korea, every judicial trial on the law had been so far managed by the professional judge. Formally speaking, there had been no judicial trial which the people had participated in the process, and there had been no case which had been done even as a sample. In this way, it had been thought by most of people that traditionally the judicial trial would have been managed only by the qualified and the professionally-trained judge on the top-grade. However, most of modern states has been attempting to make the system of the people-in-trial together with the judge who should manage with all processes in judicial trial. It represents that the people is not just in the passive role of receiving the judicial trial as an attendant, but still in the positive role of join the trial process as an participant. Those actions show the effort to provide the judicature with the democratic validity. The argument of “the people’s participation in judicial trial” has been raising simultaneously the issue of jurisdiction independence. The discussion on this issue deals with the independence from the external and internal intervention. In such a background, the government had legislated the “the law on the people’s participation in criminal trial” since Jan. 1st 2008. In the modern history of legislation, this law is sure to be the historical monument by showing the people’s sovereignty actualized by the judicial regulation.

국민의 사법참여, 즉 국민이 재판에 참여하여 직업법관과 함께 판결을 선고하는 것은 ‘민주주의’와 ‘법치국가’ 실현을 위해 의미 있는 일이다. 이러한 국민의 사법참여는 “모든 권력은 국민으로부터 나온다.”는 헌법 제1조 제2항의 규정과 “모든 국민은 헌법과 법률이 정한 법관에 의해 법률에 의한 재판을 받을 권리를 가진다.”는 헌법 제27조 제1항에서 근거규정을 찾을 수 있다. 한국에서 근대사법제도가 도입된 이래 재판은 모두 직업법관에 의해 운영되어왔고, 국민이 직접 참여하는 재판의 경우는 단 한 번도 정식으로 실행된 적이 없다. 그러므로 국민 대다수는 전통적으로 재판은 신분이 보장되고 전문교육을 받은 엘리트 법관에 의해 이루어지는 것으로 생각해 왔다. 그러나 현재 대다수의 국가에서는 재판을 주재하는 법관 이외에 일반국민들도 재판에 참여하는 제도를 마련하고 있다. 그래서 단순히 국민이 재판을 받는 수동적 존재가 아니라 사법제도의 적극적 참여자로서 민주적 정당성을 부여하도록 하는 노력들이 진행되고 있다. 또한 ‘국민의 사법참여’라는 논의를 통해 사법부 독립 문제도 논의 되었다. 즉, 사법부의 독립은 외부에 의한 독립도 중요하지만 내부의 독립도 중요한 요소이다. 이러한 관점에서 논의가 진행되어 결국 우리정부는 2008년 1월 1일부터 시행되고 있는 ‘국민의 형사재판 참여에 관한 법률’을 제정하였다. 이는 근대 사법이 국민에 의한 사법통제라는 국민주권 실현을 위한 하나의 핵심적 법률임에 틀림없다.
