There are four kinds of punishment for offenders in korean legal laws: death penalty, free penalty, qualification punishment, community-based corrections(treatments). And order of lecture, order of social service are grouped into the same group as far as community-based corrections. The importance of order of lecture in producing correction public service as community-based correction cannot be overemphasized. Existing studies of order of lecture theory have focused on the legal, administrative aspects. But order of lecture has interdisciplinary character inclusive of social welfare, psychology, administrative and so on. But little attention has been given to the interdisciplinary studies of order of lecture. Therefore, this paper is intended as an interdisciplinary approach of it. I proposed new device of order of lecture inclusive of existentialism order of lecture, irregular order of lecture and so on.

우리나라의 광의의 형벌의 종류에는 자유형, 생명형, 자격형과 사회내처우가 있다. 이중에서 사회봉사명령과 수강명령은 사회내처우에 기반한 처우와 교정인 점에서는 동질적인 성격을 가진다고 할 수가 있다. 그리고 수강명령제도는 범죄인에 대한 사회내처우에 있어서 교정공공재를 생 산하는데 있어서 아주 중요한 사회내처우 제도라고 할 수가 있다. 그런데 수강명령에 관한 기존의 국내의 수많은 연구들은 거의가 수강명령에 대한 이론의 접근에서 형법적 차원에서 단일 학문적으로 접근하고 있다. 그러나 수강명령이론은 다양한 학문의 결합적인 학제적인 성격을 가진 분야의 이론임에도 이러한 학제적 성격에 착안하여 접근한 선행연구들은 거의가 없다는 것이다. 바로 이점에 착안하여 본 논문은 선행연구들에 대한 비판을 통하여 수강 명령에 관하여 다양한 학제적 접근을 하고 있으며 실존주의적 수강명령, 상대적 부정기 수강명령 등 새로운 수강명령에 관한 독창적인 이론들을 제시하였다.
