In this paper, I tried to make an proper historical placement of The KoreaConstitution of 1948(KC) between ‘Yu Jin-oh Invention Theory’ and ‘Historical Continuity Theory’. More concretely, I intended two following things. First, I wanted to lay objections against historical determinism of KC, which meant that its contents all had already determined in the previous constitutional documents. So I tried to demonstrate the differences between the KC and the previousother constitutional documents, focusing on ideas of power structure andeconomic system. Second, I wanted to show the role and its limits of Yu jin-oh in determining contents of KC at the deeper level, whom I qualified as its main drafter. Previous studies had tended to evaluate Yu’s role and limits in somewhat mechanical way, based just on analysis of the text wording. But I suggested that even the same words or trivial differences in phrases could reflect big differences in meaning and intents.

이 글은 유진오 창안론과 역사적 연속성설 사이에서 제헌헌법의 역사적 위치를, 특히 권력구조의 문제와 경제조항을 중심으로 고찰하고자 하였다. 이를 통해 다음 두 가지를 의도하였다. 첫째, 제헌헌법의 모든 내용이 역사적으로 이미 결정되어 있었다는 역사적 결정론에 이의를 제기하고자 하였다. 따라서 이 글에서는 제헌헌법이 이전의 헌법문서나 구상들과 어떤 점에서 차이를 갖는지 보이고자 하였다. 둘째, 유진오를 제헌헌법의 주된 기초자로 자리매김하고, 그 역할과 한계를 보다 심화된 차원에서 평가하고자 했다. 이전의 유진오에 대한 평가는 주로 텍스트의 단어 분석을 중심으로 하는 다소 기계적인 방법에 의존하였다. 그러나 동일한 단어나 표현의 사소한 차이가 그 의미나 의도에서 큰 차이를 가질 수 있다는 점에서, 헌법사에서 헌법 조문의 의미는 당시 사람들의 의미 이해에 기초해야 할 필요가 있음을 주장하였다.
