Changes in the Roles of the European Union’ Institution after the Treaty of Lisbon

The revolutionary treaty is the Treaty of Lisbon of December 13. 2007, effective November 1. 2009, composed of a revised Treaty on European Union(Lisbon TEU) and an accessory Treaty on the Functioning of the European Union(TFEU). The Treaty of Lisbon merged the European Community into the European Union, further modified its institutional structures, especially the European Council, and expanded its fields of action. The Commission has always been the political institution most dedicated to taking action to further EU policies and goals. The Commission as an institution is composed of one Commissioner chosen by each Member State, making a current total of 28 Commissioners. The Commission‘ main roles include action in an executive capacity, the adoption of policies and programs, the initiation and facilitation of legislation, responsibility for the application and enforcement of EU law and assistance in the progress of accession of new Member States and in revision of the Treaties. The Lisbon Treaty increased specialized Councils, by stipulating in TEU Article 18 (3) that the High Representative for Foreign and Security Policy should chair a separate Foreign Affairs Council, which was thus distinguished from the General Affairs Council. The most important composition of the Council is the General Affairs Council, because it is responsible for handling general EU affairs. The European Parliament play important most roles: ① an equal share with the Council of Ministers in the legislative process for most legislation; ② a power of veto the designation of the Commission and its President, together with a strong capacity to supervise the Commission; and ③ a power of consent, or veto, with regard to certain constitutional and quasi-constitutional decisions. There can be that the European Council, composed of the highest political leaders of the Member State governments, is the most powerful body in the European Union. The European Council has regularly endorsed key policy programs. The intergovernmental character of the European Council has been particularly manifest in its crucial role within the Common Foreign and Security Policy.

1958년 유럽경제공동체(EEC)가 설립되어 유럽공동체(EC)로 발전해 오다가, 1991년 12월에 체결되 고 1993년 11월 발효된 마스트리히트(Maastricht) 조약에 의해 유럽연합(EU)이 창설되었다. 그 후 2007년 12월 13일 체결되고 2009년 11월 1일 발효된 리스본 조약(Treaty of Lisbon)에 의해 유럽연 합의 구조와 기능이 변화되고 확장되었다. 유럽연합은 리스본 조약 이후 큰 변화를 겪고 있다. 리스 본 조약 이후 유럽연합의 기관들은 점점 초국가적 역할을 담당하고 있다. 특히 유럽의회의 권한과 기능은 강화되었다. 유럽의회는 입법권과 EU기관 감독권을 지니며, 유럽 의회는 국제협정과 조약에 대한 동의권을 지니고 있다. 즉, 유럽의회는 조약 개정에 있어서도 동의 권을 행사한다. 또한 새로운 신입 회원국을 유럽연합 가입 여부에 대한 동의권을 지닌다. 집행위원 회 위원장에 대한 리스본 조약의 규정은 간접적으로 집행위원회의 초국가적 성격을 나타내고 있다. EU 이사회의 의장국은 각 회의에서 강력한 권한을 행사한다. 또한 리스본 조약에 의해 EU 정상회 의 상임의장직이 창설되었다. 리스본 조약 이후 유럽연합의 기관들은 정부간(inter-governmental) 기관에서 차츰 초국가적(supranational) 기관으로 변화되고 있다.
