The European Union as a Model of a peaceful Nation

As an act of reflection for the horrific disasters that the humankind experienced after World War II, each country throughout the world began to code the renouncing of war in one’s constitution. For example, in the Korean constitution, the German fundamental law, Brazil constitution of 1946, and Nicaraguan constitution of 1950, the denial of invading war was legislated; in the 1947 Japanese constitution, the renouncing of war and the prohibition of arms was legislated; in the German fundamental law, the act of peace breaking, the production and transport of war material is forbidden in the law; in the constitution of the Netherlands, the peaceful solution to international conflict is legislated. Other examples such as conscientious right of refusal of military service (In German fundamental law, Netherlands constitution of 1963, and Brazil constitution of 1946), the limiting of sovereignty and the regulation of partial transferring of sovereignty (Italian constitution of 1947), the stating of a permanently neutral country (Austrian constitution of 1955) were legislated. The immediate completion of Asian countries into a single community like the European Union is not so easy. However, the combining of the European Union may be a kind of model for the fulfilling of peace. Looking back in the history of humankind, regardless of period, in terms of a peaceful period, the progress of humankind and the revival of culture has occurred. It is a well-known truth that periods of rampant violence and the out-breaking of war caused humanity to destruct and civilization regress. The completion of the European Union gives significance to Asian countries in that it constructed the order of community and fulfilled the value of peaceful existence to prevent the destruction of humanity from war and to not cause the regression of civilization. Given that issues of peace are beyond problems concerned within a single nation, and apply to issues related to other countries, it can only be solved on the premise that one will respect another country’s territory and that under any circumstances, one won’t start an invading war. The combining of the European Union has great significance as a model of peaceful nation in that becoming a single community, when it comes to member countries, there can be no problems of territory or invading war in a relation to whatever other member country.

제2차 세계대전 후의 인류가 경험한 잔혹한 참상에 대한 반성으로 세계 각국은 최고법인 헌법에 전쟁의 포기를 직접 규정하기 시작하였다. 예컨대, 1948년 한국헌법, 1949년 독일기본법, 1946년 브라질헌법 및 1950년 니카라과헌법에서는 침략적 전쟁의 부인을 규정하고 있으며, 1947년 일본헌법에는 전쟁포기와 군비금지를 규정하고 있으며, 독일기본법에서는 평화교란행위 금지와 군수물자의 생산, 수송 및 유통의 금지를 규정하고 있으며, 1963년 네델란드헌법에서는 국제분쟁의 평화적 해결을 규정하고 있으며, 이밖에도 양심적 병역거부권(독일기본법, 1963년 네델란드헌법, 1946년 브라질헌법), 주권의 제한과 주권의 부분적 이양규정(1947년 이탈리아헌법), 영세중립국선언(1955년 오스트리아헌법) 등을 규정하고 있기도 하다. 지구촌 곳곳에서는 민족, 전통 및 종교의 ‘다름’을 이유로 끊임없이 전쟁이 진행중이다. 인류의 염원인 전쟁없는 평화란 이와 같은 ‘다름’에 대한 이해와 존중을 바탕으로 대화의 화해를 통한 문제의 해결이 전제되는 경우에 가능한 것이다. 평화란 ‘다름’의 인정을 통한 갈등의 해소와 공존의 추구에 있는 것이다. 아시아국가들이 곧바로 유럽연합과 같은 하나의 공동체로서의 완성은 쉬운 일이 아닐 것이다. 유럽연합의 완성은 전쟁에 의한 인간성의 파괴를 방지하고 문명의 후퇴를 초래하지 않기 위한 평화적 공동체질서의 구축과 평화적 생존의 가치의 실현에 있다는 점에서 아시아국가에 그 의미를 던져주고 있다. 평화의 문제는 자국 내에서의 문제를 넘어서 다른 국가와의 문제가 된다는 점에서 최소한 다른 국가의 영토에 대한 존중과 어떠한 경우에도 침략적 전쟁을 하지 않겠다는 전제로 하여서 해결될 수 있다. 유럽연합의 통합은 하나의 공동체가 됨으로서 회원국의 경우 다른 어떠한 국가와의 관계에서 영토문제와 침략적 전쟁이 일어날 수 없다는 점에서 평화국가의 모델로서의 의미는 매우 크다고 할 것이다.
