This study is the right to education of North Korean defector youth related to the law and regulations. Basic concepts, support Policy Study of the content of the law and human rights education was investigated. To this end, the concept of right to education and point of view, the right to education of youth-related international and domestic North Korean standards, North Korean Youth Educational Rights related discussion, related to North Korean situation and the right to education of youth status, North Korean youth into the right to education, policies regarding support were examined. Trough this Study First, Korean education system and curriculum courses should be made for the systematic training. Second, the North Korean refugee youth and their parents support counseling and education should be made for the their settlement. Third, in charge of North Korean youth support for school teachers should be expanded more. Fourth, the law and human rights education is a wider variety of places, and should be made in a variety of ways. Finally defection laws are made for teenagers. These Findings have meaning for the defected right to education of youth issues. And key issues related to the practical measures is to be established, which will further contribute to the future North-South integration and unification era training. It can be used for Education of future generations to the direction and preparation as an important basis raw data.

본 연구는 탈북청소년의 교육권 관련 기본 개념과 법적 규정 등을 살펴보고, 관련 실태 및 현황과 정책지원 등의 내용을 고찰하며 이에 기반한 법․인권교육적 실천방안을 제안하고자 실시된 연구이다. 이를 위해 교육권의 개념 및 관점, 탈북청소년의 교육권 관련 국제 및 국내 기준, 탈북청소년 교육권 관련 논의, 탈북청소년의 교육권 관련 실태 및 현황, 탈북청소년의 교육권 관련 지원정책 현황 등을 알아보았다. 연구결과 법․인권교육 실천방안으로는 첫째, 하나원 교육과정에서부터 남한교육제도 및 과정에 대한 체계적인 교육이 이루어져야 할 것이다. 둘째, 정착지에서의 탈북청소년과 학부모에 대한 생활밀착형 상담, 교육이 이루어져야 한다. 셋째, 탈북청소년을 담당하는 학교교사에 대한 지원이 보다 확충되어야 한다. 넷째, 법인권교육이 보다 다양한 곳에서, 다양한 방법으로 이루어져야 할 것이다. 그 리고 마지막으로 탈북청소년을 위한 관련법률들이 제․개정되어야 할 것이다. 이러한 연구는 탈북청소 년의 교육권 관련 주요 쟁점과 이슈들을 고찰하여 실질적인 대책이 마련되는데 일조할 수 있을 것이며 향후 미래 통일시대 남북 통합과 후세대 양성 및 교육의 방향을 가늠하고 준비하는데 중요한 기초자료 로 활용될 수 있을 것이다.
