Since the Local Autonomy Act was enacted in 1949, this country has adopted a check-and-balance system in which local assemblies and the executives are separated in the power relationship. Accordingly, both the local assembly members and the executive chiefs are separately and popularly elected, by which checking the unilateral actions by the either party, and ensuring for the check and balance between the two organizations. But it is a reality that the local executives, not the local assemblies, have the power to recruit and appoint the local assembly staff, thus seriously hurting the autonomy of the local assemblies. Given this, the paper examines the realities relating to the personnel powers towards the local assembly staff, and suggests possible improvements.

우리나라는 1949년에「지방자치법」을 제정한 이래 지금까지 지방의회와 집행기관을 분 리 독립시키는 기관대립형을 채택하여 운영하고 있다. 이에 따라 의결기관인 지방의회와 집행기관인 자치단체장을 각각 별도로 주민의 직선에 의하여 선출하고, 두 기관 간에 상호 견제와 균형의 원리를 적용하여 어느 일방의 전횡이나, 독주를 견제하도록 하고 있다. 그 러나 지방의회직원의 임면권이 단체장에게 주어서 있어 의회의 자율권의 심대한 장애가 되어 있기 때문에 본 연구에서는 지방의회의 자율성 강화를 위해서 지방의회의 인사권 독 립 문제와 관련한 실태분석과 개선책을 강구한다.
